Petroleum (Submerged Lands) (Occupational Health and Safety) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Petroleum (Submerged Lands) Act 1967.

1.   Amendment

1.1   The Petroleum (Submerged Lands) (Occupational Health and Safety) Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 4A (Avoidance of fatigue of persons engaged in operations)

2.1   Omit the regulation, substitute the following new Part:

PART 1A—REGULATIONS FOR THE PURPOSES OF

SECTION 140I OF THE ACT

Avoidance of fatigue of persons engaged in operations

“4A.

A person who is carrying on an operation must not allow or require an employee, a contractor, or another person under his or her control, to engage in the operation for:

  • (a)

    a continuous period; or

  • (b)

    successive continuous periods;

that has, or that have, a duration that the person who is carrying on the operation could reasonably expect to be likely to adversely affect the health or safety of the employee, contractor or other person.”.

[NOTES: 1. The term “operation” is defined in s. 5 (1) of the Act to mean an activity to which Part III of the Act applies.

2.

The Department of Primary Industries and Energy has published a guideline setting out the safe working periods recommended by the Department.]
