PETROLEUM (SUBMERGED LANDS) (DATUM) REGULATIONS

Regulations under the Petroleum (Submerged Lands)Act

1. Citation

   These Regulations may be cited as the Petroleum (Submerged Lands) (Datum) Regulations.  (See back note 1)

2. Commencement

   These Regulations come into operation on the day on which, but immediately after, the Petroleum (Submerged Lands) Amendment Act 2002 commences.  (See back note 1)

3. Definition

   In these Regulations –

   "Commonwealth Regulations" means the Petroleum (Submerged Lands) (Datum) Regulations 2002 of the Commonwealth as in force from time to time other than regulation 5(4) of those Regulations or a regulation (if any) as in force from time to time after the commencement of these Regulations that re-enacts, whether with or without modification, that regulation.

4. Application of Commonwealth Regulations

   (1)      The Commonwealth Regulations are incorporated as part of these Regulations and, subject to subregulation (2), apply as a law of the Territory as part of these Regulations.

(2)      The Commonwealth Regulations apply and have force in the Territory as if –

(a)an expression in the Commonwealth Regulations that is the same as an expression defined in the Act has the same meaning as in the Act;

(b)a reference in the Commonwealth Regulations to a provision of the Petroleum (Submerged Lands) Act 1967 of the Commonwealth is a reference to the corresponding provision of the Act; and

(c)a reference in the Commonwealth Regulations to the Designated Authority is a reference to the Minister.
