Regulations under the Petroleum (Submerged Lands) Act 1981

1Citation

These Regulations may be cited as the Petroleum (Submerged Lands) (Application of Commonwealth Laws) Regulations 2004.

2Commencement

These Regulations come into operation on the commencement of the Petroleum (Submerged Lands) Amendment Act 2004.

3Definitions

In these Regulations:

Commonwealth OHS Regulations means the following regulations:

• (a)

  the Petroleum (Submerged Lands) (Diving Safety) Regulations 2002 (Cth);

• (b)

  the Petroleum (Submerged Lands) (Management of Safety on Offshore Facilities) Regulations 1996 (Cth);

• (c)

  the Petroleum (Submerged Lands) (Occupational Health and Safety) Regulations 1993 (Cth).

Commonwealth Regulations means the following regulations:

• (a)

  the Commonwealth OHS Regulations;

• (b)

  the prescribed Commonwealth Regulations.

prescribed Commonwealth Regulations means the following regulations:

• (a)

  the Petroleum (Submerged Lands) (Data Management) Regulations 2004 (Cth);

• (b)

  the Petroleum (Submerged Lands) (Datum) Regulations 2002 (Cth) other than regulation 5(4);

• (c)

  the Petroleum (Submerged Lands) (Management of Environment) Regulations 1999 (Cth);

• (d)

  the Petroleum (Submerged Lands) (Pipelines) Regulations 2001 (Cth).

4Disapplication of Territory occupational health and safety laws

For the definition of prescribed occupational health and safety laws in section 6A of the Act, the following laws are prescribed:

• (a)

  the Dangerous Goods Act 1998;

• (b)

  Part 5 of the Electricity Reform Act 2000;

• (c)

  the Work Health and Safety (National Uniform Legislation) Act 2011.

5Application of Commonwealth Regulations

• (1)

  For paragraph (b) of the definition of regulations in Schedule 4 to the Act, the Commonwealth OHS Regulations apply (with the necessary changes) for that Schedule.

• (2)

  The prescribed Commonwealth Regulations apply (with the necessary changes) as a law of the Territory.

• (3)

  Without limiting subregulations (1) and (2), changes to the Commonwealth Regulations include the following:

  • (a)

    an expression in the Commonwealth Regulations that is the same as an expression defined in the Act has the same meaning as in the Act;

  • (b)

    a reference in the Commonwealth Regulations to a provision of the Petroleum (Submerged Lands) Act 1967 (Cth) is a reference to the corresponding provision of the Act;

  • (c)

    a reference in the Commonwealth Regulations to the Designated Authority is a reference to the Minister.

  6Repeal

  The Petroleum (Submerged Lands) (Datum) Regulations (Regulations 2003, No. 7) are repealed.
