1Name of Regulations

These Regulations are the Petroleum (Submerged Lands) Amendment Regulations 2003 (No. 1).

2Commencement

These Regulations commence on 1 March 2003.

3Amendment of Petroleum (Submerged Lands) Regulations 1985

10Fees — sections 150D, 150F and 150G of the Act

  1. (1)

    For subsections 150D (4) and 150F (3) and section 150G of the Act, the fee payable for documentary information made available to a person is an amount equal to the sum of the following amounts:

    1. (a)

      if the document containing the information is lent to the person — an amount calculated at the rate of $33 per day or part of a day during which the document is on loan to the person;

    2. (b)

      if the document containing the information is not readily available and a search is necessary to locate the document — an amount calculated at the rate of $33 per hour or part of an hour after the first half hour for the time taken to locate the document;

    3. (c)

      if a document mentioned in paragraph (a) or (b) is, on the application of the person making the request, copied or sent to the person — an amount equal to all costs incurred in the copying or sending, including the costs of packaging (if any).

  2. (2)

    For subsections 150D (4) and 150F (3) of the Act, the fee payable by a person for inspecting a petroleum mining sample is an amount equal to the sum of the following amounts:

    1. (a)

      if the sample is lent to the person — an amount calculated at the rate of $33 per day or part of a day during which the sample is on loan to the person;

    2. (b)

      if the sample is not readily available and a search is necessary to locate the sample — an amount calculated at the rate of $33 per hour or part of an hour after the first half hour for the time taken to locate the sample;

    3. (c)

      if the sample is, on the application of the person, sent to the person — an amount equal to all costs incurred in the sending, including the costs of packaging (if any).
