Petroleum (Submerged Lands) Act 1973

AN ACT

To amend the Petroleum (Submerged Lands) Act 1967–1968, and for other purposes.

[Assented to 27 May 1973]

BE IT ENACTED by the Queen, the Senate and the House of Representatives of Australia, as follows:—

Short title and citation.

1. (1) This Act may be cited as the Petroleum (Submerged Lands) Act 1973.

(2) The Petroleum (Submerged Lands) Act 1967–1968 is in this Act referred to as the Principal Act.

(3) The Principal Act, as amended by this Act, may be cited as the Petroleum (Submerged Lands) Act 1967–1973.

Commencement.

2. (1) Subject to sub-section (2), this Act shall come into operation on the day on which it receives the Royal Assent.

(2) Section 6 shall come into operation on a date to be fixed by Proclamation.

 

Points, &c., to be ascertained by reference to Australian Geodetic Datum.

3. Section 156 of the Principal Act is amended by omitting from sub-section (1) the word “Where” and substituting the words “Subject to section 156a, where”.

4. After section 156 of the Principal Act the following section is inserted:—

Certain points, &c., to be ascertained by other means.

“156a. (1) In this section, “International Sea-bed Agreement” means—

(a) the Agreement between Australia and Indonesia establishing certain sea-bed boundaries signed at Canberra on 18th May, 1971;

(b) the Agreement between Australia and Indonesia establishing certain sea-bed boundaries in the area of the Timor and Arafura Seas supplementary to the Agreement referred to in paragraph (a) and signed at Jakarta on 9th October, 1972; or

(c) the Agreement between Australia and Indonesia concerning certain boundaries between Papua New Guinea and Indonesia signed at Jakarta on 12th February, 1973.

“(2) Where, for the purposes of this Act or the regulations, or for the purposes of an instrument under this Act or the regulations, it is necessary to determine the position on the surface of the Earth of a point or line specified in an International Sea-bed Agreement, or of a point on, or part of, such a line, that position shall be determined in accordance with that Agreement or, if that Agreement is varied, in accordance with that Agreement as varied for the time being.”.

Amendment of Second Schedule.

5. The Second Schedule to the Principal Act is amended—

(a) by omitting the heading to the description, and the description, of the area specified in that Schedule as being adjacent to the State of Queensland and substituting the following heading and description:—

7. The Principal Act is amended as set out in the Schedule.

Special provisions relating to certain permits.

8. (1) Where the permit area of a permit that was in force immediately before the commencement of section 5included an area in this section called “the excised area” that was part of an area specified in the Second Schedule to the Principal Act but is not part of an area specified in that Schedule as amended by this Act—

(a) upon the commencement of that section, the permit ceases to be in force in respect of the excised area but continues in. force in respect of the remainder of that permit area;

(b) the Designated Authority shall enter in the Register a memorial of the fact that the permit has ceased to be in force in respect of the excised area; and

(c) section 103 of the Principal Act as amended by this Act applies in relation to the permit as if it had been partly cancelled under that Act as so amended.

(2) Expressions used in the Principal Act that are used in sub-section (1) have the same meanings as they have in that Act,
