Petroleum Retail Marketing Sites Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Petroleum Retail Marketing SitesAct 1980.

1. Commencement

1.1 Regulations 3 and 4 are taken to have commenced on 1 June 1995.

[NOTE: The remainder of these Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2. Amendment

2.1 The Petroleum Retail Marketing Sites Regulations are amended as set out in these Regulations.

3. Regulation 3 (Prescribed oil companies)

3.1 Omit the regulation, substitute:

Prescribed oil companies

“3.

For the purposes of the definition of ‘prescribed oil company’ in subsection 3 (1) of the Act, each of the following corporations is specified:

  1. (a)

    Australian Petroleum Pty Ltd;

  2. (b)

    BP Australia Holdings Limited;

  3. (c)

    Mobil Oil Australia Limited;

  4. (d)

    Shell Australia Limited.”.

4. Schedule 1 (Specified number of retail sites)

4.1 Item 1:

Omit the item, substitute:

“1

Australian Petroleum Pty Ltd

138.”.

4.2 Item 3:

Omit the item.

5. Savings

5.1 The amendments set out in regulations 3 and 4 do not affect a right of a person under section 12 of the Act (other than a right of the Commonwealth or an authority of the Commonwealth) during the period commencing on 1 June 1995 and ending on the date of the commencement of this regulation.
