Petroleum Retail Marketing Sites Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Petroleum Retail Marketing Sites Act 1980.

1.   Commencement

1.1   Regulation 3 is taken to have commenced on 1 August 1997.

1.2   Regulation 4 commences on 1 January 1998.

[NOTE:  The remainder of these Regulations commence on gazettal: see Acts Interpretation Act 1901, s 48.]

2.   Amendment

2.1   The Petroleum Retail Marketing Sites Regulations are amended as set out in these Regulations.

3.   Amendment of regulation 3 (Schedule 1 (Specified numbers of retail sites)) of Statutory Rules 1997 No. 211

3.1   Subregulation 3.3:

Omit “87”, substitute “102”.

[NOTE:  The note following regulation 3 is taken to be altered by omitting “Item 2 reverted to its previous provisions after 31 July 1997:” and substituting “Item 2 is changed again after 31 July 1997:”.]

4.   Schedule 1 (Specified numbers of retail sites)

4.1   Item 2, column 3:

Omit “102”, substitute “87”.

5.   Application

5.1 In spite of subregulation 1.1, the amendment made by regulation 3 is taken not to affect a right of a person (other than the Commonwealth or an authority of the Commonwealth) under section 12 of the Petroleum Retail Marketing Sites Act 1980 during the period commencing on 1 August 1997 and ending immediately before the commencement of this regulation.
