Petroleum Retail Marketing Sites Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Petroleum Retail Marketing Sites Act 1980.

Principal Regulations

1. In these Regulations, “Principal Regulations” means the Petroleum Retail Marketing Sites Regulations.

Interpretation

2. Regulation 2 of the Principal Regulations is amended by omitting from sub-regulation (2) “the Schedule” and substituting “Schedule 2”.

3. Regulations 3 and 4 of the Principal Regulations are repeated and the following regulations substituted:

Prescribed oil companies

“3. For the purposes of the definition of ‘prescribed oil company’ in sub-section 3 (1) of the Act, each of the following corporations is specified:

(a) Ampol Limited;

(b) The British Petroleum Company of Australia Limited;

(c) Caltex Oil (Australia) Pty Limited;

(d) Esso Australia Limited;

(e) Mobil Oil Australia Limited;

(f) Shell Australia Limited.

Specified numbers of retail sites

“4. For the purposes of sub-section 10 (2) of the Act, the number of retail sites specified in relation to a prescribed oil company specified in Column 2 of an item in Schedule 1 is—

(a) in relation to a month in the period of 5 months commencing on 1 February 1985—the number specified in Column 3 of that item;

(b) in relation to a month in the period of 6 months commencing on 1 July 1985 the number specified in Column 4 of that item;

(c) in relation to a month in the period of 6 months commencing on 1 January 1986—the number specified in Column 5 of that item; and

(d) in relation to any month after the month of June 1986 the number specified in Column 6 of that item.

Appropriate forms for the purposes of sub-sections 11 (1), (1a), (2), (3) and (4) of the Act

“4a. (1) For the purposes of sub-section 11 (1) of the Act, the appropriate form is Form 1.

“(2) For the purposes of sub-section 11 (1a) of the Act, the appropriate form is Form 2.

“(3) For the purposes of sub-sections 11 (2) and (4) of the Act, the appropriate form is Form 3.

“(4) For the purposes of sub-section 11 (3) of the Act, the appropriate form is Form 4.”.

Repeal of regulation 6

4. Regulation 6 of the Principal Regulations is repealed.

5. The Schedule to the Principal Regulations is repealed and the following Schedules are substituted:

STATEMENT IN RESPECT OF RETAIL SITE OPERATED DURING JANUARY 19

Name of prescribed oil company:

Name of corporation that operated retail site during the month

Particulars of situation of retail site

Specify whether the corporation owned, or was a lessee or licensee in respect of, the site on any day or days during the month

Specify whether motor fuel was sold by retail during the month at the site by or on behalf of the corporation or by a person under an agreement of the kind to which sub-paragraph 7 (1) (b) (ii) of the Act applies to which the corporation is a party

Specify whether, during the month, the site was a diesel fuel site or a site temporarily operated

In the case of a site temporarily operated, specify the circumstances by reason of which it was to be taken to be temporarily operated

STATEMENT THAT NO RETAIL SITE: WAS OPERATED DURING JANUARY 19

Name of prescribed oil company:

* The above-named company is not a member of a group of prescribed corporations. No retail sites were operated by the company during January 19

* The above-named company is a member of a group of prescribed corporations. No member of the group of prescribed corporations of which the company is a member operated any retail sites during January 19

* Omit if inapplicable.

Name of prescribed oil company:

Name of corporation that operated retail site during the month
