Petroleum Pipelines Amendment

Regulations (No. 2) 2010

Made by the Governor in Executive Council.

1.            Citation

These regulations are the Petroleum Pipelines Amendment

2.            Commencement

These regulations come into operation as follows -

(a)	regulations 1 and 2 - on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations - on the day on which the Petroleum Legislation Amendment and Repeal Act 2005 Part 3 (other than section 29(2)) comes into operation.

3.           Regulations amended

These regulations amend the Petroleum Pipelines Regulations 1970.
4.	Regulation 2 deleted Delete regulation 2.

5.            Regulation 4BA deleted

Delete regulation 413A.

6.            Regulations 4E to 17 deleted

Delete regulations 4E to 17.

7.            Regulation 18 amended

(1)	In regulation 18 delete "Under Secretary for Mines." and insert:
Minister.
(2)	At the end of regulation 18 insert:

Penalty: a fine of $5 000.

8.            Regulation 19 deleted

Delete regulation 19.

9.           Regulation 20 amended

(1)	In regulation 20(1) delete "designed as indicated in the Second Schedule, or signs".
(2)	At the end of regulation 20 insert:

Penalty applicable to subregulations (1) and (2): a fine

of $5 000.

10. Regulation 21 amended
In regulation 21:

(a) delete "inspector" and insert:

inspector, for the purposes of the Act other than a listed

OSH law,

(b) delete "a construction" and insert:

a construction, modification or reconstruction

(c) delete "the construction" and insert:

the construction, modification, reconstruction

(d) delete "Act or these regulations." and insert:

Act.

11.          Regulation 23 amended

(1) In regulation 23(1):

(a)	delete paragraph (a) and "and" after it;
(b)	in paragraph (b) delete "safeguard human life and".

(2) In regulation 23(2) delete "Under Secretary for Mines" and

insert:

Minister

(3) At the end of regulation 23 insert:

Penalty applicable to subregulations (1) and (2): a fine

of $5 000.

12.          Regulation 24 replaced

Delete regulation 24 and insert:

24. Transitional provision - time for bringing
proceedings for offences committed before certain

amendments

(1) In this regulation -

section 29(1) Petroleum Legislation

means the inserts section 66BA of the Act).

(2) The Criminal Procedure Act 2004 section 21(2) as in

section 29(1) applies to an offence against the effect immediately before the commencement of commencement as if section 29(1) had not been enacted.

13.          Regulation 25 deleted

Delete regulation 25.

14.          Regulation 27 deleted

Delete regulation 27.

15.          Second Schedule deleted

Delete the Second Schedule.
