Petroleum and Geothermal Energy Resources

(Hydraulic Fracturing) Amendment

Regulations 2021

Made by the Lieutenant Governor and deputy of the Governor in
Executive Council.

1.   Citation

These regulations are the Petroleum and Geothermal Energy

Resources (Hydraulic Fracturing) Amendment
Regulations 2021.

2.   Commencement

These regulations come into operation as follows —

(a)	regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on the day after that day.

3. Regulations amended

These regulations amend the Petroleum and Geothermal Energy

Resources (Hydraulic Fracturing) Regulations 2017.

4.            Regulation 3 amended

(1) In regulation 3 insert in alphabetical order:

existing petroleum authority area has the meaning

given in regulation 3A(1);

iconic natural heritage place means an area (shown

for information purposes on the map in Schedule 2)

that is —

(a)	part of the West Kimberley National Heritage place; and
(b)	an existing petroleum authority area on the day on which the Petroleum and Geothermal

Energy Resources (Hydraulic Fracturing)

Amendment Regulations 2021 regulation 4

commences;

West Kimberley National Heritage place means the
place included in the National Heritage List (as defined
in the Environment Protection and Biodiversity
Conservation Act 1999 (Coimionwealth)
section 324C(1)) by instrument published in the
Commonwealth ofAustralia Gazette No. S13 2 on

31 August 2011.

(2)	In regulation 3 in the definition of moratorium area paragraph (a) delete "area as defined in regulation 3A(l); or" and insert:
area; or
(3)	In regulation 3 in the definition of South West region delete "item 8." and insert:
item 8;
5.	Regulation 4 amended In regulation 4:

(a) in paragraph (g) delete "area." and insert:

area;

(b)	after paragraph (g) insert:
(h) an iconic natural heritage place.

6. Schedule 2 inserted
After Schedule I insert:
