s1 3 s4 Petroleum Amendment (No. 3) No. 280, 1995 ˙ Short title 1. This regulation may be cited as the Petroleum Amendment Regulation (No. 3) 1995 . ˙ Regulation amended 2. This regulation amends the Petroleum Regulation 1966 . ˙ Replacement of s 4 3. Section 4— omit, insert— ˙ Forms 4. The chief executive may approve forms for use under this regulation.’. ˙ Amendment of s 5 (Interpretation) 4.(1) Section 5(1), words from ‘In these regulations’ to ‘that is to say:—’ omit, insert— ‘In this regulation—’. (2) Section 5(1), definitions “authorised person” , “deputy person-in- charge” , “electrician” , “explosive” , “inspector” , “magazine” , “operator” , “person in charge” , “senior petroleum engineer” , “senior staff surveyor” , “State mining engineer” omit. (3) Section 5(1)— insert— “authorised person” , in relation to the performance of a function, means a person the person in charge authorises to perform the function. “deputy person in charge” means a person appointed under this regulation as the deputy for a person in charge.
s5 4 s5 Petroleum Amendment (No. 3) No. 280, 1995 “electrician” means a person licensed as an electrical worker under the Electricity Act 1994 . “explosive” see Explosives Act 1952 . “inspector” means a person appointed by the Minister as an inspector of petroleum operations. “magazine” see Explosives Act 1952 . “operator” means— (a) a person appointed by the titleholder to be in charge of an operation under a petroleum title; or (b) if there is no person appointed—the titleholder. “person in charge” , of a petroleum operation, means the person holding office under this regulation as the person in charge of the operation. “senior petroleum engineer” means the officer of the department holding office as senior petroleum engineer.’. (4) Section 5(1), words from ‘ “Voltage” ’ to ‘direct current system.’— omit, insert— “voltage” see section 5A.’. (5) Section 5(1), definition “waste” , ‘—in addition to its ordinary meaning’— omit, insert— ‘includes’. (6) Section 5(2)— omit. ˙ Insertion of new s 5A 5. After section 5— insert— ˙ Meaning of “voltage” 5A.(1) In this regulation, “voltage” has the same meaning as in the Electricity Act 1994 .
s6 5 s7 Petroleum Amendment (No. 3) No. 280, 1995 (2) Voltage of not more than 32 volts alternating current or 115 volts direct current is “extra low voltage” . (3) Voltage higher than extra low voltage but not higher than 250 volts is “low voltage” . (4) Voltage higher than low voltage but not higher than 650 volts is “medium voltage” . (5) Voltage higher than 650 volts is “high voltage” .’. ˙ Replacement of s 8 6. Section 8— omit, insert— ˙ Person in charge 8.(1) The operator must appoint a person to be in charge of each operation under the operator’s petroleum title— (a) before starting operations; and (b) after operations start—whenever there is no person in charge. (2) The appointment must be written and in the approved form. (3) The operator must immediately notify the State mining engineer in the approved form of the appointment and the name and address of the person in charge. (4) The person in charge must ensure, to the best of the person’s ability, all workers under the person’s control, know and comply with all relevant regulations applying to the operations, including regulations about accident prevention.’. ˙ Amendment of s 17 (Entry on land) 7.(1) Section 17(1)(a), ‘in form F of the Schedule hereto’— omit, insert— ‘in the approved form’.
s8 6 s9 Petroleum Amendment (No. 3) No. 280, 1995 (2) Section 17(2), ‘in Form G of the Schedule hereto’— omit, insert— ‘in the approved form’. ˙ Replacement of s 20 8. Section 20— omit, insert— ˙ Operations in forests and National Parks 20.(1) This section applies to the following land— (a) land that is a State forest, timber reserve or forest entitlement area under the Forestry Act 1959 (a “forest area” ); (b) land in a protected area. (2) A titleholder must not conduct, or permit someone else to conduct, a drilling or exploration program on land covered by the titleholder’s petroleum title that is a forest area or a protected area without the written consent of— (a) for a forest area—the Primary Industries Corporation; or (b) for a protected area—the chief executive of the department within which the Nature Conservation Act 1992 is administered. (3) The titleholder must comply with any conditions of the consent.’. ˙ Replacement of ss 22–23 9. Sections 22 and 23— omit, insert— ˙ Plant 22. A titleholder or operator must not use plant for petroleum operations unless the plant is designed, manufactured, constructed, tested, operated and maintained in accordance with a standard prepared by Standards Australia applying to the plant, or another standard or code ensuring safe operation of the plant and acceptable to the chief executive.
s 10 7 s 11 Petroleum Amendment (No. 3) No. 280, 1995 ˙ Water supply 23.(1) This section applies if an operator wants to— (a) drill a water bore on land to obtain water for use for operations under a petroleum title; or (b) do either of the following for obtaining water for petroleum operations or for sale or lease— (i) convert an abandoned well into a water well; (ii) produce water from the casing annulus of a producing or suspended well; or (c) obtain water from an existing well operated under a licence under the Water Resources Act 1989 for use for petroleum operations on the land on which the well is situated. (2) The operator must apply for the Minister’s permission to do anything mentioned in subsection (1). (3) The application must be in the approved form and be accompanied by the fee of $17.40. (4) The Minister may grant the permission and impose conditions on it.’. ˙ Omission of s 23B (Application by holder of Authority to Prospect for authority to extend to others) 10. Section 23B— omit. ˙ Replacement of s 23CA 11. Section 23CA— omit, insert— ˙ Land not open to permit or lease 23CA.(1) Subject to section 18(8) of the Act, the Governor in Council must not grant a lease under the Act over land in Queensland.
s 12 8 s 15 Petroleum Amendment (No. 3) No. 280, 1995 (2) The Governor in Council must not grant a permit over land in schedule 2.’. ˙ Omission of s 38 (Boilers) 12. Section 38— omit. ˙ Amendment of s 114 (Notification before carrying out operations) 13. Section 114(1)(a), ‘on such of the Forms M, N, or O of the Schedule hereto as is applicable’— omit, insert— ‘in the relevant approved form’. ˙ Omission of s 241A (Pipeline charges) 14. Section 241A— omit. ˙ Insertion of new ss 245–248 15. After section 244— insert— ˙ Delegation by chief executive 245. The chief executive may delegate powers of the chief executive under this regulation to an officer of the department. ˙ State Mining Engineer and other references 246.(1) A reference in this regulation to the State mining engineer or senior staff surveyor is taken to be a reference to the chief executive. (2) A reference in this regulation to the senior petroleum technologist is taken to be a reference to the senior petroleum engineer.
s 16 9 s 16 Petroleum Amendment (No. 3) No. 280, 1995 (3) This section expires on the date of the first reprint of the regulation produced under the Reprints Act 1992 . ˙ Approved forms 247.(1) This section applies if— (a) immediately before the commencement of this section, there was a prescribed form for a matter; and (b) on the commencement of this section, there is to be an approved form for the matter. (2) Until there is an approved form for the matter, the form that was the prescribed form for the matter immediately before the commencement of this section is taken to be the approved form for the matter. (3) This section expires 3 months after it commences. ˙ Repeals 248. All subordinate legislation, other than this regulation, made under the Act is repealed.’. ˙ Omission of sch 1 (Forms) 16.
