Pesticides Amendment (Qualifications)

Regulation 2010

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Pesticides Act 1999.

Explanatory note
Clause 9 of the Pesticides Regulation 2009 sets out a number of qualifications that allow a person to use a pesticide. The object of this Regulation is to provide that a person is also qualified to use a particular pesticide if a pesticide control order under Part 4 of the Pesticides Act 1999 specifies qualifications that are required to be held for use of the pesticide and the person holds those qualifications.

This Regulation is made under the Pesticides Act 1999, including section 119 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Pesticides Amendment (Qualifications)
Regulation 2010.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Pesticides Regulation 2009

Clause 9 Persons qualified to use pesticides

Insert after clause 9 (1) (f):

(g) if the pesticide is the subject of a pesticide control order that authorises the use of the pesticide by persons who hold specified qualifications—those qualifications.
