Pesticides (Amendment) Act 1992

An Act to amend the Pesticides Act 1989

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Short title

1.  This Act may be cited as the Pesticides (Amendment) Act 1992.

Principal Act

2.  In this Act, “Principal Act” means the Pesticides Act 1989.1

Public notices

3.  Section 45 of the Principal Act is amended by omitting all the words after “cause” and substituting “a notice about dealing with a pesticide to be published in the Gazette and in a daily newspaper published and circulating in the Territory”.

Form

4.  Section 47 of the Principal Act is amended by inserting after subsection (1) the following subsections:

“(1A)  Where, in a notice under subsection (1), the Registrar would, but for this subsection, be required to specify the distinguishing name of more than 1 pesticide, the Registrar is to be taken to have published a notice in accordance with paragraph (1) (a) if the notice—

(a)specifies the class of pesticides to which the notice relates; and

(b)includes a statement that, in relation to each pesticide included in the specified class of pesticides, particulars of the kind referred to in paragraph (1) (a) may be inspected by the public during office hours at the office of the Registrar or at such other place as is specified in the notice.

“(1B)  The Registrar shall cause copies of particulars of the kind referred to in paragraph (1A) (b) to be made available for inspection by the public at the office of the Registrar or at such other place as is specified in the notice.”.
