PESTICIDES ACT 1978—REGULATION

(Relating to the power to waive and remit fees under the Pesticides

Act 1978)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Pesticides Act 1978, has been pleased to make the Regulation set forth hereunder.

The Pesticides Regulation 1979 is amended by omitting clause 39 and

by inserting instead the following clause:

Waiver and remission of fees: prescribed circumstances for the purposes of sec. 74
39. (1) For the purposes of section 74 of the Act, the circumstances set out in subclause (2) are prescribed as circumstances in which the Minister may waive or remit fees payable under section 8 (2) (b) of the Act with respect to:

(a) an application for registration of a pesticide; or

(b)

an application for registration of a label for a class of containers for a pesticide; or

(c)

an application for approval of a specification for a class of containers for a pesticide.

(2) The circumstances referred to in subclause (1) are as

follows:

That the pesticide is the subject of a certificate of clearance in force under the Agricultural and Veterinary Chemicals Act 1988 of the Commonwealth, being a certificate that clears the pesticide for registration in New South Wales.

EXPLANATORY NOTE

The object of this Regulation is to amend the Pesticides Regulation 1979 so as to

ensure that the Minister may waive or remit fees payable under the Pesticides Act

1978 with respect to applications concerning pesticides that have been cleared for registration under the Agricultural and Veterinary Chemicals Act 1988 of the Commonwealth.

This Regulation is made under the Pesticides Act 1978, including section 73 (the

general regulation making power) and section 74.
