AN ACT to amend section four of the Pensioners

(Rates Rebates and Deferments) Act, 1966-1978.

[Assented to 25th October, 1979.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

Short title

1. (1) This Act may be cited as the Pensioners and citation.

(Rates Rebates and Deferments) Act Amendment

(2) In this Act the Pensioners (Rates Rebates and

Deferments) Act, 1966-1978, is referred to as the	Acts Nos. 5 of 1977 and 99 of
principal Act.	1978.

(3) The principal Act as amended by this Act may be cited as the Pensioners (Rates Rebates and Deferments) Act, 1966-1979.

Commence-

ment. 2. (1) The provisions of this Act, other than section 4, shall be deemed to have come into operation on the 1st July, 1979.

(2) Section 4 of this Act shall come into operation

on the 1st July, 1980.

Section 4

amended. 3. Section 4 of the principal Act is amended

(a)	as to subsection (1), by deleting the words "other than water in return for rates or charges in lieu of rates", in the last two lines of the subsection, and substituting the passage ", other than such quantity as is prescribed by way of allowance which the owner is entitled to receive in respect of rates or charges in lieu of rates, notwithstanding that such charges for water supplied comprise a component of a water rate or charge in lieu of rates" ;
(b)	as to subsection (3), by adding, after the comma ending paragraph (b) and as part of paragraph (b), the passage "save where the land is owned by persons as tenants in common of undivided shares in that land and that rebate or deferment relates to an assessment made in respect only of the portion of that land of which that pensioner is the actual occupier," ; and
(c)	by adding a new subsection, to stand as subsection (5), as follows

(5) Where, pursuant to paragraph (b) of subsection (3) of this section, rates or charges are deferred in respect of any land the title to which is held by tenants in common in undivided shares then notwithstanding the provisions of any other Act the liability for the payment of

the rates or charges so deferred attaches only to the portion of that land in relation to which the deferment was allowed and shall not be taken to extend to any other portion of that land. .

4. Section 4 of the principal Act is amended by 4 deleting the word "twenty-five", in line four of amended. subsection (1), and substituting the word "fifty".
