AN ACT to amend section three of the Pensioners

(Rates Exemption) Act 1922-1936.

[Assented to 25th October, 1938.1

BE it enacted by the King's Most Excellent Majesty,by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. This Act may be cited as the Pensioners (Rates Short title.

Exemption) Act Amendment Act, 1938, and shall be

read as one with the Pensioners (Rates Exemption)

any member of the forces within the meaning of the Australian Soldiers' Repatriation Act, 1920-1937, of the Commonwealth; and

their wives or

widows.

(b)

the wife, within the meaning of Division 5 of Part III. of the said last-mentioned Act, of any member of the forces mentioned in paragraph (a) hereof ; and

(c)

the widow (formerly the wife within the mean- ing of Division 5 of Part III. of the said last-mentioned Act) of any member of the forces mentioned in paragraph (a) hereof

who is in receipt of a service pension under the pro- visions of Division 5 of Part III. of the said Aus- tralian Soldiers' Repatriation Act, 1920-1937, in the same manner and to the same extent as if such mem- ber, wife or widow were a pensioner of the kind men- tioned in section two of this Act: Provided that it' the property in respect of which exemption from rates is claimed under this section is a War Service Home within the meaning of the War Service Homes Act, 1918-1937, of the Commonwealth, the consent of the War Service Homes Commissioner to the first charge hereinbefore mentioned shall be obtained before the exemption specified in section two of this Act shall become effective.
