Penalty Units and Other Penalties Amendment Act 2011

An Act to amend the Penalty Units and Other Penalties Act 1987

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Penalty Units and Other Penalties Amendment Act 2011 . 2CommencementThis Act commences on the day on which this Act receives the Royal Assent. 3Principal ActIn this Act, the Penalty Units and Other Penalties Act 1987 is referred to as the Principal Act. 4Section 4A amended (Indexation of penalty units) Section 4A of the Principal Act is amended as follows: (a) by inserting the following subsection after subsection (4) : (4A)  An order under subsection (3) is a statutory rule. (b) by inserting the following subsection after subsection (7) : (7A)  Notwithstanding subsections (3) and (4)  – (a) the value of a penalty unit for the financial year commencing on 1 July 2010 is taken to be and to have always been $130; and (b) the value of a penalty unit for the financial year commencing on 1 July 2011 is taken to be and to have always been $130. 5Repeal of ActThis Act is repealed on the ninetieth day from the day on which it commences.
