1. Pursuant to s 40 of the Judiciary Act 1903 (Cth), the applicant seeks removal of part of the cause now pending in the Supreme Court of Victoria, being proceeding numbered S ECI 2024 07079, between the applicant and the respondent ("the Proceeding").

2. The Proceeding does not raise an issue of wide and significant public importance which requires urgent resolution and would justify interruption of the appellate process of the Supreme Court of Victoria, the absence of the reasons of that Court, and allowing the applicant to by-pass the requirements of s 35A of the Judiciary Act.

3. The application for removal is refused with costs.
