  1. The applicant applies for an order under s 40 of the Judiciary Act 1903 (Cth) removing "the questions of law of the cause now pending in the Magistrates' Court of Victoria, between Fletcher v Peers P11451549".

  2. The application does not raise any real issue arising under the Constitution or involving its interpretation, nor any other issue that warrants urgent consideration by this Court. In any event, this Court should not fragment the orderly progression of the proceedings.

  3. The application for removal is refused with costs.
