AN ACT to amend the Pearling Act, 1912-1931.

[Assented to 6th December, 1932.]

BE it enacted by the King's Most Excellent Majesty, byCouncil and Legislative Assembly of Western Australia, inand with the advice and consent of the Legislative

this present Parliament assembled, and by the authority of

the same, as follows:—

1.    This Act may be cited as the Pearling Act Amendment Short title.

Act, 1932, and shall be read as one with the Pearling Act, sSec4 No. 13 of 1029,

1912-1931 (No. 45 of 1912, as reprinted in the Appendix to ;00 .No. 14 of

the Sessional Volume of the Statutes for the year 1924, and 1931, 3. 3'

as amended by No. 7 of 1928, No. 13 of 1929, and No. 14 of

1931), hereinafter referred to as the principal Act.

2.    Section sixteen of the principal Act is amended by in- .ii:.iendmen I of s.

serting a subsection after subsection (3), as follows:

(4) The Governor may at any time, and from time to time by notice published in the Government Gazette, pro- hibit the granting of any ship license which will increase the number of ship licenses granted and operating at the date of such publication. Such prohibition may relate to pearlshell areas generally, or to a particular pearlshell area, or to a defined portion of a particular pearlshell area, and may continue for such period as the Governor thinks fit.

Amendment of s.

45.                   3. Section forty-five of the principal Act is amended, as

follows :-

(a)

by inserting, after subsection one, a subsection, as follows

(la.) It shall be lawful for the Governor by Order in Council published in the Government Gaz- ette to limit the total quantity of pearlshell which may be gathered or collected during any specific period from any specified pearlshell area or areas by the holder of any ship license:

Provided that where any person holds more than one ship license operating in a pearlshell area to which such Order in Council relates, the total quan- tity of pearlshell which may be gathered or col- lected by such person from such pearlshell area shall be the quantity ascertained by multiplying the quantity specified in the Order in Council by the number of ship licenses held by such person as aforesaid.

(b)

by deleting from subsection two the word "such" and adding at the end of the said subsection the words "issued either under subsection (1) or sub- section (la) of this section."
