REGULATIONS UNDER THE PEARL-SHELL OVERSEAS MARKETING ACT 1927.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, do hereby make the following Regulations under the Pearl-shell Overseas Marketing Act 1927, to come into operation forthwith.

Pearl-shell Overseas Marketing (Preparation of Rolls) Regulations.

Short title.

1. These Regulations may be cited as the Pearl-shell Overseas Marketing (Preparation of Rolls) Regulations.

Definitions.

2. In these Regulations unless the contrary intention appears—

“The Act” means the Pearl-shell Overseas Marketing Act 1927;

“The Minister” means the Minister for Markets and Migration;

“The Secretary” means the Secretary of the Department of Markets and Migration.

“The poll” means the poll of producers under section 2 of the Act;

“The election” means the election of members of the Board in pursuance of sub-section (2) of section 4 of the Act.

List of voters to be prepared.

3. (1) Pursuant to claims made under these Regulations, the Secretary shall prepare a roll of producers for the State of Western Australia and a roll of producers for the State of Queensland and the Territory of North Australia, showing the total number of licensed pearling vessels owned by each producer, the total number of licensed attendant schooners owned by each producer, the authority by which they were licensed, the period covered by the licences, and the place at which the vessels or schooners are operating.

(2) The rolls shall be certified by the Secretary by writing under his hand to be correct and shall be the rolls of producers to be used for the purposes of the poll and the election.

(3) Any firm or company which is a producer may, in accordance with Form A in the Schedule to these Regulations, appoint a representative to sign the claim for enrolment and to vote on its behalf at the poll and at the election.

(4) The rolls shall be conclusive evidence of the rights of the producers or the representatives of the producers named therein to vote at the poll and the election.

Claims for enrolment.

4. (1) The only producers entitled to vote at the poll and the election are those who have been placed on the roll pursuant to claims made by them or by their representatives.

(2) Claims for enrolment shall be made on or before a date notified in the Gazette by the Minister, and no claims received after that date shall be accepted for enrolment.

(3) A claim for enrolment shall be in accordance with Form B in the schedule to these Regulations.

Appointment of Representative.

 being a firm* or company* which is a producer within the meaning of the Pearl-shell Overseas Marketing Act 1927 do hereby appoint of as the representative of the said firm* or company* and do hereby authorize the said representative on its behalf to sign the claim for enrolment of the said firm* or company* as a producer and to vote at the poll taken under section 2 of the said Act and at the election held under sub-section (2) of section 4 of the said Act.

Claim for Enrolment.

Statutory Declaration.

I,  a producer [or the duly authorized representative of   a producer] do hereby claim to have my name [or the name of   ] and the particulars set out in this statutory declaration placed on the roll of producers.

And I do solemnly and sincerely declare that the total number of pearling vessels or attendant schooners owned by me [or by  ] the authority by which they were licensed, the period covered by the licence, and the place at which they are operating are respectively as stated in columns (3) (4) (5) (6) and (7) hereunder:—

(1) Name of Producer. (2) Address of Producer. (3) Number of Licensed Vessels. (4) Number of Licensed Attendant Schooners. (5) Authority by which Licensed. (6) Period covered by Licence. (7) Place or Places at which Vessels or Schooners Operating.

And I make this solemn declaration by virtue of the Statutory DeclarationsAct 1911, conscientiously believing the statements contained therein to be true in every particular.

(b) Signature of Magistrate, Justice of the Peace, or Commissioner for taking Affidavits, or Commissioner for Declaration before whom the Declaration is made.

(c) Here insert title of person before whom the Declaration is made.

Note.—Any person who wilfully makes a false statement in a statutory declaration is guilty of an indictable offence, and is liable to imprisonment, with or without hard labour, for four years.
