HIS HONOUR:  My orders are:

  1. appeal allowed;

  1. that the appellant/defendant be released on a recognisance under section 19 of the Penalties and Sentences Act upon entering into a recognisance in the sum of $250 conditioned that he must be of good behaviour and appear for conviction and sentence if called upon at any time within a period of four months from today;

  1. there will also be a condition that the appellant/defendant attend an appropriate drug assessment and education session by the 23rd of May 2009;

  1. the respondent Prosecutor, the police, pay the appellant/defendant's costs of and incidental to this appeal as agreed between the parties or as assessed.
