1Name of rule

The name of this rule is the Pay Parking Fees Rule 2019.

2Commencement

This rule commences on 1 July 2019.

3Repeal

The Pay Parking Fees Rule 2018 is repealed.

4Relevant parking fees for ticket parking spaces

The National Land (Road Transport) Ordinance 2014 applies ACT Laws (generally about pay parking) to National Land. The Minister has the authority to determine fees under Section 96 (determination of fees, charges and other amounts) of the Road Transport (General) Act 1999 (ACT).

The relevant parking fee for a ticket parking space in a ticket parking area mentioned in an item in schedule 1 is –

(a) if the ticket parking area is described as ‘multi-stay’ in column 1 of schedule 1 and the fee is paid by an applicable pre-paid multi-day parking ticket—the amount for the ticket worked out in accordance with schedule 2; or

(b) in any other case—the amount worked out in accordance with the fees for the item in column 3 of schedule 1.

The parking fees are applicable from the date specified in the relevant schedule.

Note Ticket parking areas are established by the NCA Chief Executive under section 35 of the Road Transport (Safety and Traffic Management) Regulation 2017, which applies to National Land under the National Land (Road Transport) Ordinance 2014.

5Payment of fee

A fee under this rule is payable to the Commonwealth by a person parking a vehicle in a pay parking space.

6Definitions

In this instrument:

applicable - a multi-day parking ticket is applicable in relation to a ticket parking space in a ticket parking area mentioned in an item in schedule 1 if the ticket is for a ticket parking area with an all-day rate under column 3 of the schedule that is the same as, or lower than, the all-day rate for which the ticket is issued.

multi-day parking ticket, for a ticket parking area, means a parking ticket for parking all-day in the area that is issued for a period mentioned in column 1 of schedule 2.

multi-stay parking area has the meaning given to ‘RTA multi-stay ticket parking area’ in section 213K(5) of the Road Transport (Road Rules) Regulation 2017 (ACT) which applies to National Land by virtue of the National Land (Road Transport) Ordinance 2014.
