Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Pawnbrokers and Second-hand Dealers Act 1996.

Explanatory note
The object of this Regulation is to extend an exemption from the requirement imposed on second-hand dealers to use electronic means of creation and storage of records kept for the purposes of the Pawnbrokers and Second-hand Dealers Act 1996. The exemption will extend to any person who held a licence under the now repealed Second-hand Dealers and Collectors Act 1906, and not just to those who held a licence immediately before the repeal of that Act on 30 April 1997, and will no longer be dependent on the person never having previously been required to use electronic means of creation and storage of records.

This Regulation is made under the Pawnbrokers and Second-hand Dealers Act 1996, including section 43 (the general regulation-making power) and clause 2 of Schedule 2 (which empowers the making of regulations of a savings or transitional nature).

(Licence Exemptions) Regulation 2011

1      Name of Regulation

This Regulation is the Pawnbrokers and Second-hand Dealers
Amendment (Licence Exemptions) Regulation 2011.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Pawnbrokers and Second-hand Dealers Regulation 2008 Clause 11 Special provisions relating to keeping of records by certain licensees

Omit clause 11 (1). Insert instead:

(1) A person who held a second-hand dealer’s licence under the Second-hand Dealers and Collectors Act 1906 may, when applying for the issue or renewal of a licence authorising the person to carry on the business of a second-hand dealer, but not the business of a pawnbroker, apply to have the licence issued or renewed without a condition requiring the use of electronic means of creation and storage of records.
