Regulation under the Pawnbrokers and Second-hand Dealers Act 1996.

Explanatory note
The object of this Regulation is to amend the Pawnbrokers and Second-hand Dealers Regulation 2015 to
increase certain fees payable under the Pawnbrokers and Second-hand Dealers Act 1996.
The fee increases are generally in line with movements in the Consumer Price Index (rounded to the nearest
dollar), other than the fee for the issue of a replacement licence, which is aligned with the fee charged for
the same type of service in other licensing regulations.
This Regulation is made under the Pawnbrokers and Second-hand Dealers Act 1996, including sections 9,
13 and 43 (the general regulation-making power) and, in particular, section 43 (1) (g).

1      Name of Regulation

This Regulation is the Pawnbrokers and Second-hand Dealers Amendment (Fees)
Regulation 2016.

2      Commencement

This Regulation commences on 1 July 2016 and is required to be published on the
NSW legislation website.

Omit “Column 2” from clause 8 (3). Insert instead “Column 3”.

Note. This amount is consequently a processing fee for the purposes of Part 2 of the Licensing and Registration (Uniform Procedures) Act 2002. If an application is made by electronic communication, the processing fee is discounted (see section 13 of that Act). If an application is refused or withdrawn, the applicant is entitled to a refund of all fees paid, other than the processing fee (see section 22 of that Act).
