His Excellency the Lieutenant-Governor, with the advice of the Executive Council, has made the following Regulation under the Pawnbrokers and Second-hand Dealers Act 1996.

Explanatory note
The object of this Regulation is to exempt Verser Technology Lifecycles Pty Ltd, as a licensed second-hand dealer under the Pawnbrokers and Second-hand Dealers Act 1996, from the operation of provisions of the Act that require a licensee:

(a) to keep a record of the residential address and date of birth of any individual who acts as agent of a vendor or consignor in a transaction for the acquisition of second-hand goods by the licensee, and
(b) to furnish to the Commissioner of Police, within the prescribed time, particulars of any record that the licensee is required, by a condition of licence, to create and store in electronic form.

This Regulation is made under the Pawnbrokers and Second-hand Dealers Act 1996, including section 43 (the general regulation-making power), in particular section 43 (1) (i).

1      Name of Regulation

This Regulation is the Pawnbrokers and Second-hand Dealers
Amendment (Exemption) Regulation 2013.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Pawnbrokers and Second-hand Dealers Regulation 2008

Clause 37A

Insert after clause 37:

37A Specific exemptions from certain requirements relating to
records

Verser Technology Lifecycles Pty Ltd is exempted from the operation of:

(a) section 16 (1) of the Act, to the extent that it requires a licensee who carries on the business of a second-hand dealer to keep records containing particulars, prescribed by clause 12 (2) (b), of the residential address and date of birth of an agent of a vendor or consignor, and
(b) section 16 (5A) of the Act, to the extent that it requires a licensee to furnish to the Commissioner of Police particulars of a record that are required to be so furnished by clause 15 (1).
