CaseChat Overview and Summary
The legal issues addressed by the court included whether the employer had followed the necessary steps to establish a valid reason for termination, and if the employer had allowed Mr Marshall to respond to the allegations against him. The court also examined whether the employer had provided adequate information to Mr Marshall to enable him to respond effectively to the termination. Furthermore, the court assessed whether the employer had genuinely considered Mr Marshall's response and if the decision to terminate was made in accordance with the law.
The Fair Work Commission found that the employer had not followed the correct procedure in terminating Mr Marshall's employment. The employer failed to provide Mr Marshall with sufficient information to respond to the allegations against him, and did not genuinely consider his response. The court held that the termination was unfair and not compliant with the statutory requirements. Consequently, the Commission ordered the employer to reinstate Mr Marshall to his previous position and compensate him for the loss of wages and entitlements.
