[ASSENTED TO 28TH JANUARY, 1916.J E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis-. lative Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows : - Short title. 1. The Governor in Council may from time to fbuentdaskmenay time, by Order in Council published in the Gazette, with over. the consent of the person or persons or a majority of the persons (all of whom are herein referred to as "the trustees") for the time being constituting the trustees of or having the possession, management, or control of any sums of money standing to the credit of any fund, by whatever name called, which have been raised by voluntary contribution amongst the people of Queensland, and whether other persons have or have not contributed to the same, for affording aid, assist- ance, relief, or benefit in connection with the present War, or on being satisfied that there has been or is any maladministration by the trustees of any of such moneys, declare that, on and from a date to be stated in such Order, all or any of such moneys shall be divested from the trustees, and shall be and become vested in the Chief Secretary, representing the Government of Queens- land, on the same trusts or for tl~ e same purposes or objects as the same are presently held, and shall be managed and administered by the Chief Secretary under this Act; and every such Order shall have effect accordingly.

The trustees of any moneys mentioned in such Order shall, pursuant to the same, pay over such moneys to the Ohief Secretary or some person appointed in such Order to receive the same on his behalf. (3.) The receipt of the Ohief Secretary or such person for the same shall be a sufficient discharge, and the trustees shall not thereafter be liable or accountable therefor or be bound to see to the application, distribution, or appropria- tion thereof. (4.) All such moneys so received by or on behalf of the Ohief S~ ecretary shall be invested by him on deposit at the Government Savings Bank at Brisbane to the credit of such account or accounts as he thinks fit, and, notwithstanding any Act to the contrary, shall bear interest upon the total amount thereof at the current prescribed rate of interest. (5.) All acts and things done and all payments made Confirma.tion before the date on which any such Order in Council takes o~ ! : r. : ~ ~ effect with respect to any fund by the trustees in or in :ion of f:'d. relation to the administration of such fund, or in or for the purpose of executing the trusts thereof, are hereby declared to be valid and effectual for all purposes, and are hereby ratified and confirmed; and no trustee, or person acting under the direction or authority of the trustees, or any chairman or presiding or executive officer of the trustees, shall be liable in any proceeding whatsoever for any such act or thing done or payment made. 4. Every fund referred to in the last preceding sec- Audit. tion, and whether or not the Governor in Council has made any Order under that section in relation thereto, shall be audited from time to time by the Auditor-General or some officer of his Department; and for that purpose each of the persons having the custody or control of any such fund shall be deemed to be a public accountant within the meaning of " The Audit Act of 1874."* 5. (1.) rrhe Governor in Council may from time to Regulations. time make all such regulations as he deems necessary for giving full and complete effect to the objects and purposes of this Act and for securing the due and proper adminis- tration, management, and control of any fund received by or on behalf of the Ohief Secretary pursuant to any such Order in Oouncil as aforesaid, and for carrying into execution the trusts to which such fund may be subject. (2.) The regulations may provide that the trustees of any fund who are subject in the administration thereof to the directions of some association or body outside * 38 Vie. No. 12, supra, pag~ 74.

No. 22, Queensland may, with the approval of such association or body, pay over to the Chief Secretary the moneys standing to the credit of such fund in Queensland and for the administration thereof thereafter by the Chief Secretary under this Act for the same purposes and subject to the like directions. (3.) The regulations may prohibit or restrict the soliciting by any .person of any contributions or aid in connection with the present War except with the authority of the Chief Secretary. (4.) The regulations may provide a penalty not ex- ceeding twenty pounds for any contravention thereof to be recovered in a summary way by complaint under " The Justices Acts, 1885 to 1909."* (5.) All such regulations upon pUblication in the Gazette shall be read as one with this Act and be of equal validity, and shall be judiciaHy noticed. (6.) Such regulations shall be laid before both Houses of Parliament within fourteen days after such publication, if Parliament is in session, and, if not, then within fourteen days after the commencement of the next session. (7.) If either House of Parliament passes a resolution disallowing any such reg~ lation, of which resolution notice has been given at any time within fourteen sitting days of such House after such regulation has been laid before it, such regulation shall thereupon cease to have effect, but without prejudice to the validity of anything done in the meantime.
