PATRIOTIC FUNDS. 2 E liz . II. No. 26,1953. Patriotic Funds Act Armndrmn Me*. 237 PATRIOTIC FUNDS. An Act to Amend “ The Patriotic Func s Act of 2 N E o l . iz 2 . 6. II. 1942,” in certain particulars, T he P atriotic F unds A ct A mendment [A ssented to 18 th D ecember , 1953.] A ct of 1953. B E it enacted by the Queen’s Most Excellent Majesty, _ by and with the advice and consent of the Legis lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:— 1 . This Act may be cited as “ The Patriotic Funds Short title Act Amendment Act of 1953,” and shall be read as one ^c?ion. with *“ The Patriotic Funds Act of 1942,” herein referred to as the Principal Act. The Principal Act and this Act may be collectively CoJieotive cited as “ The Patriotic Funds Acts , 1942 to 1953.” title‘ 2. Section three of the Principal Act is amended— Amendments (i.) By inserting the following definition after the° S‘ ' definition of the term “ Chief Secretary ” in that section:— “ “ Defence service ”—Any service declared by Defence the Governor in Council to be a defenceservice- service under and for the purposes of this Act (the Governor in Council being hereby empowered to declare from time to time, by Order in Council published in the Gazette , any service, wherever served, for which any members of the Naval, Military, and Air Forces of the Commonwealth, or any of those Forces, were before, or are after, or were partly before and are partly after the passing of f“ The Patriotic Funds Act Amendment Act of 1953,” enlisted or appointed, to be a defence service under and for the purposes of this Act);” ; (ii.) By repealing in the definition of the term “ Patriotic fund ” in that section the words and brackets “ in which His Majesty is at present, or has heretofore been or may hereafter be, engaged (and any reference in this Act to “ the war ” shall be deemed to include a * 6 G. 6 No. 38. f This Act.

No. 26, reference to any such war)” and by inserting, in lieu of those repealed words and brackets, the words and brackets “, or any active service (including with the forces of the United Nations), in which Her Majesty (including any of Her Majesty’s Predecessors or Successors according to law), or any of Her Majesty’s Naval, Military, and Air Forces or any of the Naval, Military, and Air Forces of any countries of the British Commonwealth, shall have been or shall be engaged, whether before, or after, or partly before and partly after the passing of *“ The Patriotic Funds Act Amendment Act of 1953,” or in connection with any defence service (and any reference in this definition or in any other provision of this Act to “ the war ” shall be construed as referring to any and every such war, to any and every such active service, and to any and every defence service)”; (iii.) By inserting after the words “ out of employment ” in paragraph (/) of the definition of the term “ Patriotic fund ” in that section the words “ or, because of any other circumstances whatsoever whether associated with the war or not, are in need of aid, relief, assistance or support”; also by adding to that paragraph (/) the words “, or of the dependants of deceased such officers and members whose deaths (whether attributable in any way to the war or not so attributable) occurred (and in any and every such case whether death occurred before, on or after the passing of *“ The Patriotic Funds Act Amendment Act of 1953 ”) after ceasing to be such officers or members ; and (iv.) By adding after paragraph ( j ) of the definition of the term “ Patriotic fund ” in that section the words “ but does not include the fund or any part of the fund of the Australian Red Cross Society Amendment 3. Section four of the Principal Act is amended by of s. 4. adding to subsection five thereof the following paragraph, namely :— “Moreover the Governor in Council may approve of such only of the objects and purposes stated in such an application as are specified by him and in that event, he shall be deemed to have refused to approve of the remaining objects and purposes stated in that application.” * This Act.
1953. PATRIOTIC FUNDS. PatrioticFundsActAmendmentAct. 239 4. Section nine of the Principal Act is amended— Amendments (i.) By inserting the following subsection after” s' ’ subsection one of that section :— “ (2.) For the purpose of carrying out any objects or purposes of any patriotic fund the trustees may subject to the approval of the Chief Secretary borrow moneys from time to time on the security of any property belonging to the fund.”; and (ii.) By renumbering subsection two of that section subsection three thereof and by inserting in that subsection, as so renumbered, after the words “ or other property of a patriotic fund ” the words “ and all borrowings pursuant to subsection two of this section 5. (1.) Queensland Trustees, Limited (hereinafter sale of land referred to as “ the trustees ”), in whom the piece °f j^nSon8 land described in the Schedule to this Act (hereinafter jack ciub. referred to as “ the said land ”) is vested under nomination of trustees No. A501352 entered in the register book kept at the Office of the Registrar of Titles at Brisbane and as Trustees for Union Jack Club, may sell to the Returned Sailors, Soldiers, and Airmen’s Imperial League of Australia, Queensland Branch (hereinafter referred to as “ the League ”), subject to such terms and conditions as to price and otherwise as may be agreed between the trustees and the League and approved by the Governor in Council, th’ e sai. . d. ... l.a. . n. . d. .. , ... i.n. . c. .. u. .. d. . ing al"l improvements thereon. (2.) The said land when sold as aforesaid shall be held by the League under and subject to the constitution, rules and by-laws of the League, but absolutely freed and discharged from the trusts upon and subject to which the said land was theretofore held. (3.) Money received by the trustees from the sale of the said land shall form part of the Union Jack Club Fund. SCHEDULE. [Section The piece of land situated in the City of Brisbane County of5^1^ Stanley Parish of North Brisbane being allotment numbered 165A containing two roods more or less and being the whole of the land contained in Certificate of Title No. 180361 register book volume 1085 folio 101.
