Patents Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Patents Act 1990.

1.   Amendment

1.1   The Patents Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation

Act 1901, s. 48.]

2.   Regulation 5.1 (Application of this Chapter)

2.1   Subparagraph 5.1 (a) (iii):

Omit “is made under regulation 9.5 (‘completion of re-examination’) or”.

3.   Schedule 6A (Prescribed employee—subsection 209 (1) of the Act)

3.1   Omit the Schedule, substitute:

 SCHEDULE 6A Regulation 21.2

PRESCRIBED EMPLOYEE—SUBSECTION 209 (1) OF THE ACT

A person employed in the Patent Office in the following positions:

  • (a)

    Administrative Services Officer:

    • (i)

      Class 2—Annuities Officer;

    • (ii)

      Class 3—Examination Request Officer;

    • (iii)

      Class 5—Manager, Australian Receiving Office;

    • (iv)

      Class 5—Manager, Patent Filing;

    • (v)

      Class 6—Manager, Patent Notification;

    • (vi)

      Class 5—Manager, Patent Support;

    • (vii)

      Class 5—Manager, Publications;

    • (viii)

      Class 4—Opposition Officer;

    • (ix)

      Class 3—Patent Support Amendment Officer;

    • (x)

      Class 2—Publication Officer;

    • (xi)

      Class 3—Register Officer;

    • (xii)

      Class 2—Sealing Officer;

    • (xiii)

      Class 4—Supervisor, OPI/Acceptance;

    • (xiv)

      Class 3—Supervisor, Patent Filing;

    • (xv)

      Class 4—Supervisor, Patent Support;

  • (b)

    Examiner of Patents;

  • (c)

    Senior Officer, Grade B;

  • (d)

    Senior Officer, Grade C;

  • (e)

    Senior Professional Officer, Grade B;

  • (f)

    Senior Professional Officer, Grade C.

4.   Schedule 7 (Fees)

4.1   Schedule 7, Part 3:

Add at the end:

“8

late payment fee under Rule 16bis.2 of the PCT

the greater of:

(a) 50% of the amount of the unpaid fees specified in the invitation; and

(b) the amount of the transmittal fee;

but not more than the amount of the basic fee”.
