REGULATIONS UNDER THE PATENTS ACT 1952*

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Patents Act 1952.

AMENDMENTS OF THE PATENTS REGULATIONS 

Commencement

1. These Regulations shall come into operation on 17 October 1977.

Parts

2. Regulation 2 of the Patents Regulations is repealed.

Fees

3. Regulation 5 of the Patents Regulations is amended—

(a) by omitting from sub-regulation (5) “ item 33 ”and substituting “ item 31 ”;

(b) by omitting from sub-regulation (5) “ apply to ” and substituting “ apply to a request for ”;

(c) by omitting from sub-regulation (5a) “ item 12 ”and substituting “ item 11 ”;

(d) by omitting from sub-regulation (7) “ items 36 or 37 ” and substituting “ items 34 or 35 ”;

(e) by omitting from paragraph (b) of sub-regulation (7) “ appeal ” (wherever occurring) and substituting “ application ”; and

(f) by omitting from paragraph (b) of sub-regulation (7) “ Appeal Tribunal from ” and substituting “ Administrative Appeals Tribunal for a review of ”.

Complete specifications

4. Regulation 7b of the Patents Regulations is amended—

  • (a)

     by omitting sub-regulation (9); and

    (b) by omitting from sub-regulation (10) “ this regulation ” and substituting “ these Regulations ”.

Continuation fee

5. Regulation 16a of the Patents Regulations is amended—

(a) by omitting sub-regulation (1) and substituting the following sub-regulations:

“ (1) For the purposes of section 47d of the Act, the prescribed continuation fee in relation to an application for a patent shall be, in respect of a year after the complete specification in relation to that application was lodged, the fee specified in column 3 of item 6 of the Second Schedule opposite to the reference in column 2 of that item to that year.

“ (1a) For the purposes of section 47d of the Act, the prescribed time within which the applicant shall pay the prescribed continuation fee in respect of a year is that year.”; and

(b) by omitting from sub-regulation (2) “ item 7 ” and substituting “ item 6 ”.

Renewal fees

6. Regulation 29 of the Patents Regulations is repealed and the following regulation substituted:

“ 29. (1) For the purposes of sub-section 68 (2) of the Act, the fee specified in column 3 of item 20 of the Second Schedule in relation to a year of patent is the renewal fee in respect of that year of patent.

“ (2) For the purposes of sub-section 68 (2) of the Act, the prescribed time in respect of the payment of a renewal fee in relation to a year of patent is that year of patent.

“ (3) An application for an extension of time for payment under sub-section 68 (3) of the Act shall be in accordance with Form 11.”.

Mode of advertisement

7. Regulation 37 of the Patents Regulations is amended—

(a) by omitting from sub-regulation (1) “ the High Court ” (wherever occurring) and substituting “ a prescribed court ”; and

(b) by adding at the end of sub-regulation (2) “ and, where he intends to present the petition to a prescribed court, shall identify the prescribed court ”.

Notification of decision under subsection 160 (2) of the Act, or of result of appeal in relation to such a decision, in Official Journal

8. Regulation 49 of the Patents Regulations is amended—

(a) by omitting “ (2) of section 160 ” and substituting “ 160 (2) ”; and

(b) by adding at the end thereof the following sub-regulation:

“ (2) Where, under section 151 of the Act, the Administrative Appeals Tribunal reviews a decision of the Commissioner under sub-section 160 (2) of the Act and decides to vary the decision under review or set aside the decision under review and make a decision in substitution for the decision so set aside, the Commissioner shall cause to be published in the Official Journal a notification of that decision of the Tribunal.”.

Amendments of documents on request

9. Regulation 76 of the Patents Regulations is amended—

(a) by omitting from sub-regulation (1) “ The Commissioner ” and substituting “ Subject to sub-regulation (6), the Commissioner ”;

(b) by omitting from sub-regulation (2) “ The Commissioner ” and substituting “ Subject to sub-regulation (6), the Commissioner ”;

(c) by omitting from sub-regulation (3) “ The Commissioner ” and substituting “ Subject to sub-regulation (6), the Commissioner ”; and

(d) by omitting paragraph (c) of sub-regulation (6) and substituting the following paragraph:

“ (c) shall not make the amendment until after—

(i) the expiration of the period during which a person interested may give notice of opposition to the request in accordance with regulation 77;

(ii) any such notice of opposition has been determined; and

(iii) the document or instrument in relation to which the request is made is open for public inspection; and ”.

Determination of request for amendment

10. Regulation 78 of the Patents Regulations is amended by omitting sub-regulation (2) and substituting the following sub-regulation:

“ (2) Proceedings may be instituted in a prescribed court by way of appeal against a decision of the Commissioner under sub-regulation (1).”.

11.After regulation 91 of the Patents Regulations the following regulation is added:

Review of certain decisions by Administrative Appeals Tribunal

“ 92. Applications may be made to the Administrative Appeals Tribunal for review of decisions made by the Commissioner in exercise of the powers conferred on him by sub-regulation 7b (8) or 16f (6) or by regulation 44 or 52.”.

12. The Second Schedule to the Patents Regulations is repealed and the following Schedule substituted:

Transitional

13. (1) Notwithstanding the provisions of the Patents Regulations as amended by these Regulations, where a renewal fee was, before the commencement of these Regulations, paid in respect of a year of a patent, being a year that expires on or after 17 October 1977, the fee so paid shall be the renewal fee payable in respect of that year of the patent.

(2) Notwithstanding the provisions of the Patents Regulations as amended by these Regulations, where, in relation to an application for a patent, a continuation fee under section 47d of the Patents Act 1952 has been paid in respect of a year, being a year that expires on or after 17 October 1977, the fee so paid shall be the continuation fee payable under that section in respect of that year.

(3) The amendments effected by regulations 4 and 10 do not affect any proceedings under the Patents Regulations instituted in the High Court as the Appeal Tribunal before the commencement of these Regulations, or anything arising out of, or any proceeding incidental to, or connected with, any such proceeding.
