1Name of Regulations

 These Regulations are the Patents Amendment Regulations 1999 (No. 2).

2Commencement

 These Regulations commence as follows:

  • (a)

    on gazettal — regulations 1 to 3 and Schedule 1;

  • (b)

    on 6 September 1999 — Schedule 2.

3Amendment of Patents Regulations 1991

 Schedules 1 and 2 amend the Patents Regulations 1991.

  • (1)

    A title established by the ISA under rule 37.2 of the PCT for an international application is taken to be the title of the specification.

  • (2)

    For subregulation (1), if the established title is in a language other than English, the title is taken to be the English translation of the established title.

 For subsection 209 (1) of the Act, the Commissioner may delegate all or any of the Commissioner’s powers or functions under the Act, except the powers and functions under paragraphs 210 (a) and (c) of the Act, to an employee of the Patent Office:

  • (a)

    holding, or performing the duties of, the position of Examiner of Patents; or

  • (b)

    employed at any of the following levels:

    • (i)

      Executive level 1 or 2;

    • (ii)

      APS level 2, 3, 4, 5 or 6.
