Patents Amendment Regulations 1998 (No. 5)2

I, WILLIAM PATRICK DEANE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following regulations under the Patents Act 1990.

1.   Name of regulations

1.1   These regulations are the Patents Amendment Regulations 1998 (No. 5).

2.   Commencement

2.1   These regulations commence on gazettal.

3.   Amendment

3.1   The Patents Regulations are amended as set out in these regulations.

4.   Regulation 1.1 (Citation)

4.1   Omit the regulation, substitute:

Name of regulations

 “1.1 These regulations are the Patents Regulations 1991.”.

5.   Regulation 21.2 (Delegation by Commissioner under subsection 209 (1) of the Act)

5.1   Omit the regulation, substitute:

Employees to whom Commissioner may delegate (Act, s 209 (1))

 “21.2 (1) For subsection 209 (1) of the Act, subregulation (2) applies.

 “(2) An employee holding, or performing the duties of, a position in the Patent Office stated in Schedule 6A is an employee to whom the Commissioner may delegate all or any of the Commissioner’s powers or functions under the Act, except the powers and functions under paragraphs 210 (a) and (c) of the Act.”.

6.   Schedule 4 (Convention countries)

6.1   After:

“San Marino”,

insert:

“Sao Tome and Principe, Democratic Republic of”.

7.   Schedule 6A (Prescribed employee—subsection 209 (1) of the Act)

7.1   Omit the Schedule, substitute:
