An Act to amend the Pastures Protection Act, 1934, with respect to offices of profit under pastures protection boards. [Assented to, 9th April, 1980.]

Pastures Protection {Amendment).

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

Short title.

1. This Act may be cited as the “Pastures Protection

(Amendment) Act, 1980”.

Amendment

2. The Pastures Protection Act, 1934, is amended in the

manner set forth in Schedule 1.

Transitional

3.

A person who, immediately before the commencement of

provision.

(a)

was a director of a pastures protection board under the Pastures Protection Act, 1934; and

(b) held an office of profit under that board.

shall cease to hold oflice as that director if, at the expiration of 21 days after that commencement, he holds an ollice of profit under that board.

SCHEDULE 1.

Sec. 2.

Amendments to the Pastures Protection Act, 1934.

(1) Section 6 (7) —

Before “Where an extraordinary vacancy occurs”, insert :—

An extraordinary vacancy occurs in the office of

chairman or deputy-chairman if an extraordinary vacancy

occurs in the office of the director who is the chairman or

deputy-chairman, as the case may be.

(2) (a) Section 8 (1) —

Omit

chairman, or deputy-chairman”.

(b)

Section 8 (1) (h ) - ( j )—

Omit section 8 (1) (h), insert instead :—

(h) attains the age of 70 years; or

( i)    holds an ollice of profit under the board—•

(i)   in the case of a director elected at a general election under section 6 (3 )—- immediately after he takes office as a director; or

(ii)   in any other case—at the expiration of 21 days after his election or appointment; or

(j) accepts an office of profit under the board.

(c) Section 8 (2) —

Omit “, chairman, or deputy-chairman”.

(3) Section 12a (a )—

Omit “chairman, deputy-chairman or director cease to hold office as such chairman, deputy-chairman or director”, insert instead “director, cease to hold office”.
