REGULATIONS UNDER THE PASSPORTS ACT 1920.

I, THE person administering the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Passports Act 1920, to come into operation forthwith.

Passports Regulations.

Short title.

1. These Regulations may be cited as the Passports Regulations.

Definitions.

2. In these Regulations, unless the contrary intention appears—

“Australian passport” means a passport issued by or on behalf of the Government of the Commonwealth;

“British passport” means a passport issued by or on behalf of the Government of any British country, and includes an Australian passport;

“ Certificate of identity ” means a certificate issued under these Regulations by or on behalf of the Department of Home Affairs to Russian or Armenian refugees;

“Foreign passport” means a passport issued by or on behalf of the Government of any country other than a British country;

“Passport” means an Australian passport;

“ Permit ” means any document, other than a passport or a certificate of identity, issued by or on behalf of the Department of Home Affairs, authorizing the person named and described therein to embark at any place in the Commonwealth for a journey to a specified place beyond the Commonwealth;

“The Act” means the Passport Act 1920;

“Transit visé ” means a visé which is valid for one or more direct journeys through the United Kingdom or specified British territory undertaken for the sole purpose of reaching a foreign country; and

any reference to a form shall be read as a reference to a form in the Schedule.

 

Officers authorized to received applications for and to renew and visé passports.

3. Applications for passports shall be made to, and passports may be renewed or viséed by any of the following officers, or officers thereto authorized by them, namely:—

The Secretary, Department of Home Affairs-;

The Collectors of Customs of the States of New South Wales, Victoria, Queensland, South Australia, Western Australia and Tasmania.

The Government Resident of North Australia.

Persons to whompassports may be issued.

4. Passports may be granted only to natural-born or naturalized British subjects located within the Commonwealth at the date of application.

Applications for passports.

5. —(1.) An application for a passport may be in accordance with Form A, Form B, Form C or Form D, as the case requires, and shall be—

(a) signed by the applicant;

(b) indorsed by an authorized person with a certificate that he personally knows the applicant, that to the best of his knowledge and belief the statements contained in the application are true, and that the applicant is of good character and is a fit and proper person to receive a passport; and

(c) accompanied by the prescribed fee, and by two unmounted photographs of the applicant, one of which shall be indorsed on the back by the person certifying the application with a certificate that the photograph is a genuine photograph of the applicant.

(2.) An application for a passport made by a person under the age of sixteen years must be accompanied by a statement in writing by the applicant’s father (or mother, if she is a widow, or if for any other reason, satisfactory to the officer empowered to issue the passport, the statement cannot conveniently he obtained from the father) or guardian, consenting to the issue of a passport and setting out in whose care the applicant intends to travel.

(3.) For the purpose of this regulation, “authorized person” means—

(a) a Police, Stipendiary or Special Magistrate of the Commonwealth or of a State or of the Northern Territory, a Justice of the Peace, a legally qualified Medical Practitioner, a Minister of Religion or Bank Manager; or

(b) any person or class of persons approved by the Minister.

Fee for passport.

6. The fee for the issue of a passport shall be Ten shillings.

Family passports.

7. It shall not be necessary for married women travelling with their husbands, or children under the age of sixteen years travelling with their parents or guardians, to obtain separate passports, but particulars relating to them shall be included in the passports issued to their husbands, parents or guardians, as the case may be.

Naturalized British subjects to produce certificate of naturalization

8. Where an applicant for a passport is a naturalized British subject, he shall forward his certificate of naturalization, with his application, for inspection.

Form of passport.

9. —(1.) A passport shall be in accordance with Form E.

(2.) Where a passport is issued to a naturalized British subject, the fact and extent of his naturalization shall be stated on the passport.

Countries for which passports available.

10. Subject to the next succeeding regulation, a passport shall be available only for travel to the countries indorsed thereon, but it may be indorsed for additional countries by an officer authorized to visé passports.

Empire-wide passports.

11. —(1.) The Minister, or any officer thereto authorized by him, may, if he sees fit so to do, indorse for travel within the British Empire any British passport other than a passport issued to a naturalized British subject whose naturalization is effective only in the country in which it was granted.

(2.) For the purposes of this regulation, “British Empire” includes all Territories under British protection or under British government under a mandate with the exception of Palestine and Iraq.

Duration of passport.

12. A passport, unless specially indorsed for a shorter period, shall be valid for a period of five years and subject to those Regulations may be renewed for further periods of from one to five years:

Provided that in no case shall the validity of a passport be extended beyond ten years from the original date of issue.

Delivery of passports.

13. Except where otherwise authorized by the Minister, an applicant shall attend in person at the Department of Home Affairs or at the Customs House at the proposed port of departure, within fourteen days prior to the advertised date of sailing of the vessel mentioned in his application, to take delivery of his passport, and if so required shall at the same time produce his boat ticket for inspection by the officer delivering the passport.

Cancellation of old passports.

14. Where an applicant for a passport is already the holder of a passport he shall produce that passport for cancellation before a fresh passport is issued.

Loss of passport.

15. A fresh passport shall not be issued to replace a lost passport, unless the officer to whom application is made has satisfied himself by inquiry or otherwise that the lost passport cannot be traced.

Application for renewal of passport.

16. An application for the renewal of a British passport may be in accordance with Form F and shall be—

(a) signed by the applicant;

(b) indorsed in the manner prescribed in paragraph (b) of sub-regulation (1) of regulation 5 of these regulations; and

(c) accompanied by a fee of One shilling for each year for which renewal of the passport is applied for, and, in the case of a passport other than an Australian passport, by a photograph certified in the manner prescribed in paragraph (c) of that sub-regulation.

When applications for renewal ofpassport may be made.

17. An application for the renewal of a passport may be lodged at any time, except in the case of intended travel when, if not already renewed, it shall be lodged at least seven days prior to the proposed date of departure.

Passport not renewable where space for indorsement is exhausted.

18. Where the space provided for indorsements on a passport is already exhausted, the passport shall cease to be renewable.

Passport not renewable when grantee ceases to be a British subject.

19. Where, after the issue of a passport, the grantee ceases to be a British subject, the passport shall cease to be renewable and shall be cancelled.

Form of indorsement of renewal.

20. The indorsement to be inscribed on a passport to indicate that it has been renewed may be in accordance with the following form;—

“Renewed until (date of expiration of term for which renewed).

and shall be signed by an officer authorized to renew passports.

Visé of passport.

21. Holders of British passports travelling to any country for which their passports are not already indorsed, and holders of Foreign passports departing from the Commonwealth, shall make application for an indorsement or visé at least seven days prior to the proposed date of their departure.

22.—(1.) An application for a visé or indorsement may be in accordance with Form G and shall be accompanied by—

(a) the prescribed fee; and

(b) in the case of a passport other than a passport issued under the Act, one unmounted photograph of the applicant.

(2.) The fees payable in respect of a visé or indorsement of a passport shall be as follows:—

(а) For a transit visé—Two shillings;

(b) For an indorsement of a British passport for travel to countries not already included in the passport—Two shillings; and

(c) For visé (other than a transit visa) of a foreign passport— Eight shillings.

23. —(1.) A visé on a passport may be in one of the following forms:—

(a) in the case of a British passport—

Permits.

23a.—(1.) A permit to leave Australia, sufficiently describing the holder, may be issued in lieu of a passport—

(a) to a British subject who is about to leave Australia under circumstances which, in the opinion of an officer authorized to issue passports, render it unnecessary or undesirable to issue a passport to such person; and

(b) to any alien who is about to leave Australia, and is required to be in possession of a passport or equivalent document, but who cannot arrange to obtain such document from a consular representative of the country of which he claims to be a national.

(2.) The fee for a permit shall be Ten shillings, but such fee shall not be payable where a permit is issued for travel—

(а) to the Territory of New Guinea; or

(b) to the Solomon Islands via Rabaul, or to Fiji, and for return to Australia by the same vessel on the same trip.

Issue of certificate of identity to Russian and Armenian refugees.

23b.—(1.) A certificate of identity, sufficiently describing the holder, may be issued—

(a) to any Russian refugee in conformity with the resolution of the Government Conference convened by Dr. Nansen, High Commissioner for Russian Refugees at Geneva, July, 1922; or

(b) to any Armenian refugee in conformity with the plan submitted, by the High Commissioner for Refugees on 31st May, 1924; for the approval of interested Governments.

(2.) The fee for a certificate of identity shall be Five shillings.

Exemption from payment of fees.

24. The following classes of persons shall be exempt from the payment of fees under these Regulations:—Commonwealth Ministers and Commonwealth Government officials travelling on official business, and the wives and children of those Ministers and officials accompanying their husbands and parents, or travelling later to join them abroad.

25. The Passport Regulations 1922, being Statutory Rules 1923, No. 24, as amended by Statutory Rules 1924, No. 26, and 1930, No. 32, are hereby repealed.
