Passports Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Passports Act 1938.

1.   Commencement

1.1   These Regulations commence on 1 July 1993.

2.   Amendment

2.1   The Passports Regulations are amended as set out in these Regulations.

3.   Regulation 9 (Certificates of identity)

3.1   Subregulation 9 (1):

Omit the subregulation, substitute:

“9.

(1) An authorized officer may issue a certificate of identity to a person (not being an Australian citizen):

  • (a)

    who is about to leave Australia or a Territory and is:

    • (i)

      stateless; or

    • (ii)

      unable to obtain a passport from a Consular representative of the country of which the person claims to be a national; or

  • (b)

    who has been determined by the Minister for Immigration and Ethnic Affairs to have the status of a refugee; or

  • (c)

    whose application for a protection visa has been approved by that Minister.”.

3.2   Add at the end:

“(3)

In subregulation (1), ‘protection visa’ means:

  • (a)

    a Class 784 (domestic protection (temporary)) visa within the meaning of the Migration (1993) Regulations; or

  • (b)

    a domestic protection (temporary) (code number 784) visa within the meaning of the Migration Regulations;

 applied for after entry.”.

4.   Schedule 2 (Fees)

4.1   Omit the Schedule, substitute:
