Passports Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Passports Act 1938.

Principal Regulations

1. In these Regulations, “Principal Regulations” means the Passports Regulations.

Validity and renewal of Australian passports

2. Regulation 7 of the Principal Regulations is amended—

(a) by inserting in sub-regulation (1) “to a person other than a prescribed minor” after “Australian passport”;

(b) by omitting from sub-regulation (1) “5” and substituting “10”;

(c) by inserting after sub-regulation (1) the following sub-regulation:

“(1a) Where an authorized officer issues an Australian passport to a prescribed minor, the day on which the validity of the passport will expire shall be a day specified by that officer in the passport, being a day not later than 5 years after the day on which the passport is issued.”;

(d) by inserting in sub-regulation (2) “issued to a person other than a prescribed minor” after “Australian passport”;

(e) by omitting from sub-regulation (2) “5” and substituting “10”; and

(f) by adding at the end the following sub-regulation:

“(3) An authorized officer may, from time to time, renew an Australian passport issued to a prescribed minor by extending the period of the validity of the passport until a day specified by that officer in the passport, being a day not later than 5 years after the day on which the passport is issued.”.

3. Regulation 11 of the Principal Regulations is amended—

(a) by omitting from paragraph (4) (d) “(other than particulars referred to in paragraph (e))”;

(b) by omitting paragraph (4) (e); and

(c) by omitting sub-regulations (5), (6), (7) and (8).

Review of decisions

4. Regulation 14 of the Principal Regulations is amended—

(a) by omitting from paragraph (b) of the definition of “Ministerial decision” in sub-regulation (1) “sub-regulation 5 (2) or 7 (2) or regulation 11” and substituting “these Regulations”;

(b) by inserting in sub-paragraph (a) (ii) of the definition of “reviewable decision” in sub-regulation (1) “or 7 (3)” after “7 (2)”;

(c) by omitting from sub-paragraph (a) (viii) of the definition of “reviewable decision” in sub-regulation (1) “or”; and

(d) by omitting paragraph (b) of the definition of “reviewable decision” in sub-regulation (1).

Schedule 2

5. Schedule 2 to the Principal Regulations is amended—

(a) by omitting item 1 and substituting the following items:

“1 For the issue of an Australian passport to a person other than a prescribed minor

$60.00

1a For the issue of an Australian passport to a prescribed minor

$25.00

”;

(b) by omitting from item 2 “$2.50” and substituting “$5.00”;

(c) by omitting from item 4 “$5.00” and substituting “$10.00”;

(d) by omitting from item 5 “$2.50 for each year or part of a year of renewal” and substituting “$5.00”; and

(e) by omitting from item 6 “$2.50 for each year or part of a year of renewal” and substituting “$5.00”.

Savings

6. (1) Notwithstanding the amendment of sub-regulation 7 (2) of the Principal Regulations made by these Regulations, that sub-regulation shall continue to apply to and in relation to the renewal of an Australian passport issued before the day on which these Regulations come into operation.

(2) Notwithstanding the omission of sub-regulation 11 (8) of the Principal Regulations by these Regulations, that sub-regulation shall continue to apply to and in relation to an endorsement made on an Australian passport in relation to a prescribed minor before the day on which these Regulations come into operation.
