REGULATIONS UNDER THE PASSPORT ACT 1920.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations, to come into operation on and from the first day of April, One thousand nine hundred and thirty.

Amendment of the Passports Regulations 1922.

(Statutory Rules 1923, No. 24, as amended to this date.)

Definitions.

1. Regulation 2 of the Passports Regulations 1922 is amended—

(a) by inserting, after the definition of “British passport”, the following definition:—

“‘Certificate of identity’ means a certificate issued under these Regulations by or on behalf of the Department of Home Affairs to Russian or Armenian refugees;”;

(b)by inserting, after the definition of “Passport”, the following definition:—

“‘Permit’ means any document, other than a passport or a certificate of identity, issued by or on behalf of the Department of Home Affairs, authorizing the person named and described therein to embark at any place in the Commonwealth for a journey to a specified place beyond the Commonwealth;”; and

(c) by inserting, after the definition of “The Act”, the following definition:—

“‘Transit visé’ means a visé which is valid for one or more direct journeys through the United Kingdom or specified British territory undertaken for the sole purpose of reaching a foreign country; and”.

Officers authorized to receive applications for passports, &c.

2. Regulation 3 of the Passports Regulations 1922 is amended—

(a) by omitting the words “and Territories” and inserting in their stead the words “Affairs”;

(b) by inserting, after the words “New South Wales”, the word “Victoria,”; and

(c) by omitting the words “Administrator of the Northern Territory” and inserting in their stead the words “Government Resident of North Australia”.

Delivery of passports.

3. Regulation 13 of the Passports Regulations 1922 is amended by omitting the words “and Territories” and inserting in their stead the word “Affairs”.

Form of application for visé.

4. Regulation 22 of the Passports Regulations 1922 is repealed and the following regulations inserted in its stead:—

“22.—(1.) An application for a visé or indorsement may be in accordance with Form G and shall be accompanied by—

(a) the prescribed fee; and

(b)in the case of a passport, other than a passport issued under the Act, one unmounted photograph of the applicant.

(2.) The fees payable in respect of a visé or indorsement of a passport shall be as follows:—

(a) For a transit visé—Two shillings;

(b) For an indorsement of a British passport for travel to countries not already included in the passport—Two shillings; and

(c) For visé (other than a transit visé) of a foreign passport —Eight shillings.”.

Form of visé.

5. Regulation 23 of the Passports Regulations 1922 is repealed and the following regulation inserted in its stead:—

“23.—(1.) A visé on a passport may be in one of the following forms:—

(a) in the case of a British passport—

‘Good for travel to............................................................................

(b) in the case of a foreign passport (ordinary visé)—

‘Seen at ..............................................................................

(c) in the case of a foreign passport (transit visé)—

Issue of permits.

6. After regulation 23 of the Passports Regulations 1922 the following regulations are inserted:—

“23a.—(1.) A permit to leave Australia, sufficiently describing the holder, may be issued in lieu of passport—

(a) to a British subject who is about to leave Australia under circumstances which, in the opinion of an officer authorized to issue passports, render it unnecessary or undesirable to issue a passport to such person; and

(b)to any alien who is about to leave Australia and is required to be in possession of a passport or equivalent document, but who cannot arrange to obtain such document from a consular representative of the country of which he claims to be a national.

(2.) The fee for a permit shall be Ten shillings, but such fee shall not be payable where a permit is issued for travel—

(a) to the Territory of New Guinea; or

(b)to the Solomon Islands via Rabaul, or to Fiji, and for return to Australia by the same vessel on the same trip.

Issue of certificate of identity to Russian and Armenian refugees.

“23b.—(1.) A certificate of identity, sufficiently describing the holder, may be issued—

(a) to any Russian refugee in conformity with the resolutions of the Government Conference convened by Dr. Nansen, High Commissioner for Russian Refugees at Geneva, July 1922; or

(b)to any Armenian refugee in conformity with the plan submitted, by the High Commissioner for Refugees on 31st May, 1924, for the approval of interested Governments.

(2.) The fee for a certificate of identity shall be Ten shillings.”.

7. The Schedule to the Passports Regulations 1922 is amended by omitting Form G and inserting in its stead the following form:—
