Passenger Transport (General) Amendment

(Drivers’ Authorities) Regulation 2018

Passenger Transport Act 1990

His Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Passenger Transport Act 1990.

Explanatory note

The object of this Regulation is to ensure the criteria applying to applicants for an authorisation to drive a public passenger vehicle are consistent for both applicants holding a NSW licence and applicants holding a licence from another State or internal Territory.

This Regulation is made under the Passenger Transport Act 1990, including sections 12 (2) and 63 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Passenger Transport (General) Amendment (Drivers’

Authorities) Regulation 2018.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Passenger Transport (General) Regulation 2017

(1) Clause 29 Criteria for authorisation to drive public passenger vehicles

Omit clause 29 (2) (b) and (c). Insert instead:

(b)

must hold an Australian driver licence that is an unrestricted licence, and

(c)

must have held an Australian driver licence, that is an unrestricted licence, for a total of at least 12 months in the 2 years immediately preceding the date of the application, and

(2) Clause 29 (5), definition of “Australian driver licence”
Omit paragraph (b) of the definition. Insert instead:

(b)

a licence issued under a law in force in a State or internal Territory authorising the holder to drive a motor vehicle on a road or road related area.

(3) Clause 29 (5), definition of “unrestricted licence”
Insert in alphabetical order:

unrestricted licence means a licence that is not a learner licence,

probationary licence, provisional licence, restricted licence, driver licence receipt or conditional licence (other than a conditional licence the sole condition of which is that the holder must wear corrective lenses at all times while driving).
