(Digital Driver Licences) Regulation 2019

Her Excellency the Governor, with the advice of the Executive Council, has made the following
Regulation under the Passenger Transport Act 1990.

Explanatory note
The objects of this Regulation are—
| (a) | to provide for the use of digital driver licences by the drivers of public passenger vehicles, and |
| (b) | to remove an offence that required the driver of a public passenger vehicle to be clean and tidy. |
This Regulation is made under the Passenger Transport Act 1990, including section 63 (the general regulation-making power).

1 Name of Regulation
This Regulation is the Passenger Transport (General) Amendment (Digital Driver
Licences) Regulation 2019.
2 Commencement
This Regulation commences on the day on which it is published on the NSW legislation website.
3 Amendment of Passenger Transport (General) Regulation 2017
(1) Clause 35 Conduct of drivers Omit clause 35(2).
(2) Clause 45 Driver to provide driver licence for inspection Omit clause 45(1). Insert instead—
(1) If an authorised officer requests a driver of a public passenger vehicle
to produce the driver’s driver licence, the driver must—
(a) hand the driver’s driver licence to the authorised officer for inspection, or (b) display the driver’s digital driver licence. Note. Section 61C of the Road Transport Act 2013 sets out the requirements for the display of a digital driver licence.
Maximum penalty—5 penalty units.
(3) Schedule 3 Penalty notice offences Omit the matter relating to clause 35(2) of the Passenger Transport (General) Regulation 2017.
