Regulation under the Passenger Transport Act 1990.

Explanatory note

The object of this Regulation is to amend the Passenger Transport (General) Regulation 2017 to appoint persons who are employed by, or contractors of, operators of a public passenger service as authorised officers for the purposes of the Passenger Transport Act 1990. Those persons are subject to the control and direction of Transport for NSW.

This Regulation is made under the Passenger Transport Act 1990, including sections 46W and 63 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Passenger Transport (General) Amendment (Authorised
Officers) Regulation 2017.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Passenger Transport (General) Regulation 2017

(1) Clause 239 Authorised officers

Insert after clause 239 (1) (h):

(i)      persons who are employed by, or are contractors of, any other operator of a public passenger service and who provide services for the purposes of that public passenger service.

(2) Clause 239 (2)
Omit “(g) or (h)”. Insert instead “(g), (h) or (i)”.
