Passenger Transport Amendment

(Disclosure of Information) Regulation 2015

under the

Passenger Transport Act 2014

His Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Passenger Transport Act 2014.

Explanatory note
The object of this Regulation is to authorise, on a transitional basis, the disclosure of certain information relating to:

(a) the accreditation, authorisation and licensing status of public passenger services and their drivers, and
(b) the compliance of a driver with requirements imposed by the regulations on drivers relating to medical examinations or qualifications.

This Regulation is made under the Passenger Transport Act 2014, including section 176 (the general regulation-making power) and clause 1 of Schedule 3 (which permits the making of savings and transitional regulations consequent on the enactment of the Act).

1      Name of Regulation

This Regulation is the Passenger Transport Amendment (Disclosure of Information)
Regulation 2015.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

Clause 14

Insert after clause 13:

14      Transitional provisions concerning disclosure of accreditation and other information under section 171 of Act

(1) This clause applies only until the 1990 Act is repealed.
(2) Section 171 (1) (a) of the Act is taken to extend to information about the accreditation, authorisation or licensing status of, or an application for an accreditation, driver authority or licence by, a person under the 1990 Act.
(3) Section 171 (1) (b) of the Act is taken to extend to information about the compliance of a driver with requirements imposed by the regulations under the 1990 Act on drivers relating to medical examinations or qualifications.
