Passenger Transport Amendment (Authorised Officers and Persons) Regulation 2010

under the

Passenger Transport Act 1990

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Passenger Transport Act 1990.

Explanatory note
The objects of this Regulation are:

(a)	to prescribe persons employed in the Independent Transport Safety Regulator Division of the Government Service as authorised officers for the purposes of the Passenger Transport Act 1990, and
(b)	to prescribe persons employed in the State Transit Authority Division of the Government Service as persons to whom the Director-General of Transport NSW may delegate his or her functions under that Act.

This Regulation is made under the Passenger Transport Act 1990, including sections 46W,

62A and 63 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Passenger Transport Amendment (Authorised
Officers and Persons) Regulation 2010.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Passenger Transport Regulation 2007

(1) Clause 239 Authorised officers

Insert after clause 239 (d):

(e) persons employed in the Independent Transport Safety Regulator Division of the Government Service (within the meaning of the Public Sector Employment and Management Act 2002).

(2)	Clause 239A
Insert after clause 239:
239A	Delegation to authorised persons

For the purposes of section 62A of the Act, persons employed in the State Transit Authority Division of the Government Service (within the meaning of the Public Sector Employment and Management Act 2002) are prescribed.
