PASSENGER TRANSPORT ACT 1990-REGULATION

(Relating to the carriage of animals and the granting of exemptions)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Passenger Transport Act 1990, has been pleased to make the Regulation set forth hereunder.

Amendment of Passenger Transport (Bus Services) Regulation 1995

1. The Passenger Transport (Bus Services) Regulation 1995 is

amended by omitting clause 14 (2) and (3).

Amendment of Passenger Transport (General) Regulation 1995

2. The Passenger Transport (General) Regulation 1995 is amended by omitting from clause 12 the words “or this Regulation” wherever occurring and by inserting instead the words “, this Regulation or any other regulation under the Act”.

EXPLANATORY NOTE

The objects of this Regulation are:

(a)

to repeal a provision that currently prohibits bus drivers from permitting animals to be carried in Government and non-Government buses; and

(b)

to enable the Director-General of the Department of Transport to exempt persons and services from the provisions of all of the regulations under the Passenger Transport Act 1990 rather than, as is presently the case, from the provisions of the Passenger Transport (General) Regulation 1995 only.

This Regulation is made under the Passenger Transport Act 1990, including section

63 (the general regulation making power).
