PASSENGER TRANSPORT ACT 1990—REGULATION
(Relating to penalties)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Passenger Transport Act 1990, has been pleasedto make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 May 1993.
Amendments
2. The Passenger Transport Regulation 1990 is amended:
(a)
by omitting from clauses 4–6, 9A, 13, 29, 52, 53, 66B and 74 the matter “ 5 penalty units” wherever occurring and by inserting instead the matter “10 penalty units’’;
(b)
by omitting from clauses 9, 10, 12, 16–19, 21, 22, 27, 28, 30, 31A–31C, 32–39, 42–51, 52B, 54–57, 59–66A, 69, 70 and 75 the matter “2 penalty units” wherever occurring and by inserting instead the matter “5 penalty units”;
(c)
by omitting from clauses 15, 20, 23–26 and 41 the matter “1 penalty unit” wherever occurring and by inserting instead the matter “2 penalty units”;
(d)
by omitting from Schedule 1 under the heading Penalty the matter “50” wherever occurring and by inserting instead the matter “100”;

| (e) | by omitting from Part 2 of Schedule 1 under the heading Penalty |
| the matter “75” wherever occurring and by inserting instead the matter “ 150”; | |
| (f) | by omitting from Part 2 of Schedule 1 under the heading Penalty |
the matter “100” wherever occurring and by inserting instead the matter “200”;
| (g) | by omitting from Part 2 of Schedule 1 under the heading Penalty the matter “200” wherever occurring and by inserting instead the matter “300”. |
EXPLANATORY NOTE
The object of this Regulation is to amend the Passenger Transport Regulation
1990:
| (a) | to increase the maximum penalties that may be imposed by courts for offences under the Regulation in the following manner: |
• existing penalties of $100 are increased to $200 (clause 2 (c))
• existing penalties of $200 are increased to $500 (clause 2 (b)) • existing penalties of $500 are increased to $1,000 (clause 2 (a));and
| (b) | to increase, from $50 to $100, the amount of penalty for offences relating to passenger behaviour if dealt with by penalty notice (clause 2 (d)); and |
| (c) | to generally increase the amount of penalty for offences relating to drivers |
