PASSENGER TRANSPORT ACT 1990—REGULATION
(Relating to driver authority cards)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Passenger Transport Act 1990, has been pleased
to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 27 August 1993.
Amendments
2. The Passenger Transport Regulation 1990 is amended:
| (a) | by inserting after clause 7A the following clause: |
Expiry of driver authority card
7AA. (1) In this clause:
“driver authority card” means:
(a) an authority card issued under clause 9; or
(b) any other card or document issued by the Director-General as evidence of the authority to drive a public passenger vehicle.
(2) A driver authority card is to specify the date on which the card expires.

(3) A driver authority card remains in force until midnight on the date specified on the card as the expiry date unless the card
has previously been cancelled or suspended.
(4) The holder of an expired driver authority card must, on the receipt of a written notice from the Director-General, immediately deliver the card to the Director-General at the address specified in the notice.Maximum penalty: 5 penalty units.
(5) A driver authority card that is in force immediately before the commencement of this clause and on which an expiry date is specified is taken to be a driver authority card on which an expiry
date is specified under this clause.

EXPLANATORY NOTE
The object of this Regulation is to amend the Passenger Transport Regulation
1990:
(a) to specifically provide for the insertion of expiry dates on driver authority cards issued by the Director-General of the Department of Transport under the Passenger Transport Act 1990 (“the Act”) to authorise persons to drive public passenger vehicles; and (b) to make it clear that a person ceases to have an appropriate authority if he or she holds an expired driver authority card; and (c) to make it an offence to fail to deliver an expired driver authority card to the Department of Transport if required to do so; and (d) to prescribe the new offence and an offence under section 11 (1) of the Act (driving a public passenger vehicle without an appropriate authority) as offences for which penalty notices may be issued and $100 as the amount of penalty payable under such penalty notices.
This Regulation is made under various provisions of the Act, including the general regulation-making power in section 63 (in particular, section 63 (2) (g) and (4)) and sections 12 and 59.
