His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Passenger Transport Act 1990.

Explanatory note
The object of this Regulation is to replace the definition of motor cycle cycle in clause 4 of the principal Regulation (which prescribes tourist service vehicles for the purposes of the Regulation) with a definition that includes motor tricycles. The new definition refers to the Australian Design Rules category definitions for motor cycles (LC Vehicles), motor cycles and side-cars (LD Vehicles) and motor tricycles (LE Vehicles).
This Regulation is made under the Passenger Transport Act 1990, including the definition of tourist service in section 3 and sections 6 and 63 (the general regulation-making power).

1 Name of Regulation
This Regulation is the Passenger Transport (General)
Amendment (Motor Cycles) Regulation 1997.
2 Commencement
This Regulation commences on 11 April 1997.
3 Amendment of Passenger Transport (General) Regulation 1995
The Passenger Transport (General) Regulation 1995 is amended as set out in Schedule 1.

The explanatory note does not form part of this Regulation.

Clause 4 Tourist services
Omit the definition of motor cycle from clause 4 (3).
Insert instead:
motor cycle means a motor vehicle that complies with
the Australian Design Rules category definition for any
of the following:
(a) motor cycles (LC Vehicles), (b) motor cycles and side-cars (LD Vehicles), (c) motor tricycles (LE Vehicles).
