CaseChat Overview and Summary

Paskins v Hail Creek Coal Pty Ltd is a case where the plaintiff, Paskins, sought damages for injuries sustained in the course of employment with the first defendant, Hail Creek Coal Pty Ltd. Paskins was hired under a contract between Hail Creek Coal Pty Ltd and the second defendant, Hail Creek Mining Services Pty Ltd, which was engaged by a third party. Paskins alleged that Hail Creek Mining Services Pty Ltd was vicariously liable for the injuries, or alternatively, that Hail Creek Coal Pty Ltd was liable for maintaining an unsafe system of work. Paskins also claimed that Hail Creek Mining Services Pty Ltd was under an obligation to indemnify Hail Creek Coal Pty Ltd in respect of Paskins' claim, based on the contract terms.

The court had to determine whether Hail Creek Mining Services Pty Ltd was vicariously liable for the injuries, and if Paskins' injuries were caused by the negligence of Hail Creek Mining Services Pty Ltd's employee, as opposed to Paskins' own negligence. The court also considered whether Paskins was contributorily negligent and, if so, what apportionment of damages should be made. Additionally, the court examined the indemnity clause in the contract between Hail Creek Mining Services Pty Ltd and the third party, to determine whether Hail Creek Mining Services Pty Ltd was required to indemnify Hail Creek Coal Pty Ltd. The court needed to assess the extent of Paskins' injuries and disabilities, and the level of future economic loss, as these were contested between the parties.

The court found that Hail Creek Mining Services Pty Ltd was vicariously liable for the injuries sustained by Paskins. The court held that the injuries were caused by the negligence of Hail Creek Mining Services Pty Ltd's employee, not by Paskins' own negligence. The court apportioned 25% contributory negligence to Paskins. It was determined that Hail Creek Mining Services Pty Ltd was obliged to indemnify Hail Creek Coal Pty Ltd under the contract terms. The court found that Paskins' symptoms and disabilities were genuine, and awarded damages for future economic loss based on Paskins' capacity to return to work and the type of work available.

Judgment was entered for Paskins against Hail Creek Coal Pty Ltd in the sum of $709,408.26, and against Hail Creek Mining Services Pty Ltd in the sum of $966,991.38.
