GLEESON CJ:   This application for special leave to appeal was heard in Canberra on 7 September 2001 by a Court constituted by Justices Gaudron, McHugh, Gummow, Kirby and myself.  On 7 September 2001 the Court made orders to refuse the application for special leave to appeal and ordered that the applicant pay the costs of the first respondent.  We indicated that we would publish our reasons at a later date.  We are now in a position to publish our reasons.  I publish the joint reasons of Justices Gaudron, McHugh, Gummow and myself.
