The applicant seeks special leave to appeal from a judgment of the Court of Appeal of the New South Wales Supreme Court (Basten AJA; Ward P and Kirk JA agreeing) dismissing an appeal against a decision of the District Court of New South Wales (Robison DCJ) that the Court had no jurisdiction to hear the claim because it was out of time by at least 30 years.
The Court of Appeal's decision was plainly correct. Special leave to appeal should therefore be refused.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
